Genes e proteínas são resultados de grande importância de ações de pesquisa e desenvolvimento da indústria da Biotecnologia. Sequências de ácidos nucléicos e aminoácidos têm sido estudadas para atender as necessidades humanas e lançadas no mercado pelo setor, que, ao investir grande quantidade de recursos ao longo do desenvolvimento de sequências biológicas, buscam a proteção do fruto de suas pesquisas de modo mais amplo possível, por meio de patentes. Em contraposição, o sistema de patentes prevê que, em troca do direito de excluir terceiros das atividades relacionadas ao objeto da patente, a sociedade deve receber a invenção suficientemente descrita, de modo a permitir que um técnico no assunto seja capaz de reproduzi-la, e apresentando reivindicações claras e fundamentadas no relatório descritivo. Entretanto, devido às suas peculiaridades, a estrutura química destes compostos engloba uma linguagem biológica, cujas propriedades desconsideram o preceito do sistema de patentes de que o escopo das reivindicações deve estar confinado às estruturas exatas reveladas no relatório descritivo das patentes. Assim, a proteção para além da sequência revelada no pedido de patente, incluindo seus equivalentes funcionais e de estrutura semelhante, entretanto, não descritos no pedido de patente, é crucial. Em contraposição, no Brasil, o Instituto Nacional da Propriedade Industrial (INPI) concede apenas uma proteção literal das sequências biológicas listadas no pedido, justificando para isso, as condições requeridas ao pedido de patente brasileiro previstas em lei. Redatores de patentes em Biotecnologia em todo o mundo têm agrupado tais moléculas por meio de características comuns em reivindicações genéricas ou de gênero, objetivando a proteção das sequências funcionalmente equivalentes a uma determinada sequência de referência, estruturalmente descrita. As estratégias de redação de reivindicações utilizadas para ampliação do escopo protegido apresentam-se como altamente heterogêneas, sem clareza e, muitas vezes equivocadas tecnicamente, o que gera como resultado, um elevado grau de incerteza quanto à proteção de sequências para além do âmbito da sequência literalmente apresentada, quando não invalidando as reivindicações. Neste contexto, o presente estudo apresenta as peculiaridades das sequências biológicas que suscitam a necessidade de uma proteção para além do escopo daquelas literalmente apresentadas no pedido de patente, em geral buscada através de reivindicações de gênero. A suficiência descritiva, como um preceito do sistema de patentes é também apresentada destacando-se o contexto atual no Brasil, tratados internacionais em propriedade intelectual, União Europeia, Estados Unidos e Índia com relação ao tema, vinculado à descrição escrita de sequências biológicas. A partir da visão aprofundada do assunto foi possível o desenvolvimento de uma análise quanto ao entendimento técnico do contexto, apresentando-se ao final, a proposição de um modelo de reivindicação de gênero tecnicamente viável para uma proteção balanceada das sequências biológicas baseado no score de similaridade, parâmetro acessível aos pesquisadores da área durante o alinhamento de sequências. A proposição de alternativas, claras, homogêneas e aplicáveis à realidade do setor é um passo primordial na proteção das sequências biológicas de maneira equilibrada entre as necessidades econômicas da indústria e o interesse público, o que, consequentemente, representará papel essencial ao estímulo da pesquisa e inovação em Biotecnologia no Brasil.
