On 11 April 2016, Timor-Leste initiated a compulsory non-binding conciliation proceeding against Australia under Annex V of the United Nations Convention on the Law of the Sea (UNCLOS) on its maritime boundary dispute with Australia in the Timor Sea. On 6 March 2018, the parties signed a settlement treaty on the basis of the proposal of the Conciliation Commission. Two months later, the Conciliation Commission issued its report, marking the conclusion of the first ever conciliation proceeding under Annex V of UNCLOS.This book provides detailed analyses of the proceedings and a step-by-step account of the conciliation process, as well as its wider implications for dispute settlement under UNCLOS and beyond. The various chapters explore a wide range of issues, including an overview of conciliation as a means of dispute settlement and the conciliation procedure in UNCLOS, as well as the origins and historical background of the maritime boundary dispute between Timor-Leste and Australia. This book examines the development of Timor-Leste’s foreign policy since achieving political independence in 2002. It considers the influence of Timor-Leste’s historical experiences with foreign intervention on how the small, new state has pursued security. The book argues that efforts to secure the Timorese state have been motivated by a desire to reduce foreign intervention and dependence upon other actors within the international community. Illegal, unreported and unregulated (IUU) fishing constitutes a persistent and pressing problem estimated to account for up to US$23 billion annually in the APFIC area. The effects of IUU fishing can be severe, particularly for small-island and coastal developing states heavily dependent on fisheries, and include adverse impacts on peoples’ livelihoods, food security, national economies and the environment. Countries unable to fulfil international obligations for fisheries management and governance risk incurring trade sanctions on their fisheries exports, an increasing issue as export markets tighten their permitting. Furthermore, IUU fishing is increasingly associated with national and transnational organised criminal activities, although the evidence remains mixed. FAO commissioned this report two years ago to produce an independent update to an unpublished 2015 study on IUU fishing in the APFIC area of competence, which was presented to the APFIC as an information paper in 2016 (FAO 2016a). The 2015 study used a mixture of media reports, literature review, and interviews to build a picture of hotspots of illegal fishing across the APFIC area of competence. This report builds on the previous work, incorporating additional analysis methods to predict illegal fishing in a transparent manner. Based on discussions with the APFIC Secretariat, it was decided to limit the study to the illegal component of IUU fishing. A key difference with the 2015 study is the extension of the estimation of illegal fishing from the 33 hotspots covered in the 2015 study to the entire APFIC area of competence in this study.This report provides the following key outputs: (i) development and implementation of an agreed methodology for estimating illegal fishing levels and progress; (ii) information from case studies in three Asia-Pacific countries; and (iii) analysis of results from the agreed method estimating the incidence of illegal fishing and implication of efforts to reduce it. The approach taken to achieve these goals included a structured online survey of fisheries officials in APFIC countries, semi-structured interviews of key informants knowledgeable about illegal fishing in the APFIC region, and analysis of articles on illegal fishing from public media data across the APFIC area of competence.

In May 2018 Bernard Collaery, a former Attorney-General of the Australian Capital Territory and long-term legal counsel to the government of East Timor, was charged by the Australian Commonwealth Director of Public Prosecutions with conspiracy to breach the Intelligence Services Act 2001. He was forbidden from talking about the charges against him, but under parliamentary privilege independent MP Andrew Wilkie revealed what has since been described as ‘Australian politics’ biggest scandal’. Five years earlier, after ASIO officers raided Collaery’s home and office, Collaery told journalists that ASIS had been bugging the East Timorese government during negotiations over Timor Sea oil. He was about to represent East Timor; as well as calling the evidence of a former senior ASIS agent known publicly only as Witness K, at The Hague in a case against the Australian government. Oil Under Troubled Water relates the sordid history of Australian government dealings with East Timor, and how the actions of both major political parties have enriched Australia and its corporate allies at the expense of its tiny neighbour and wartime ally, one of the poorest nations in the world.
