Este livro tem por objetivo tratar da possibilidade de alcançar a isenção do Imposto sobre a Renda de pessoa física (IRPF) a trabalhadores ativos que possuem patologias graves, sendo que a Lei 7.713/88 prevê que o benefício atingirá somente os inativos ou reformados. Assim sendo, a presente obra apresentará as possibilidades de se estender a isenção para caso de ativos portadores das moléstias elencadas no artigo 6°, inciso XIV, da referida Lei, levando-se em consideração os princípios constitucionais da dignidade da pessoa humana e da isonomia. Dividido em três capítulos, o primeiro capítulo aborda as noções gerais do Imposto sobre a Renda, popularmente conhecido como Imposto de Renda, ao longo do seu quase centenário, bem como as mudanças conceituais desde sua formulação até os dias atuais, passando por várias fases históricas no Brasil a partir de 1922; o segundo capítulo trata do conceito de Isenção, assim como os princípios que lhe dão sustentação, enfatizando-se os constitucionais da Dignidade da Pessoa Humana e da Isonomia; o terceiro capítulo analisa decisões judiciais tanto de julgadores legalistas positivistas (para os quais a norma deve ser interpretada literalmente) quanto daqueles que julgam a partir de uma interpretação teleológica/sistemática - além da lei, levando em consideração o fato social. Ademais, apresentaremos o entendimento do Supremo Tribunal Federal e do Superior Tribunal de Justiça frente ao tema.

English Abstract: Recently the Provisional Measure number 694 was processed by Congress in the year 2015 and was about the end of the tax exemption granted to certain FII (real estate investment funds). Although it has not been converted into law, the matter may return to the agenda of the national congress. Therefore, the objective of the study was to verify how the end of the income tax exemption would impact the investor's profitability within the IFIs and to see if its repercussion would be so significant as to propose that investors 4migrate to other types of investments. The methodology of the study was qualitative, by means of simulation of the profitability of the funds in the current scenario, considering the IR exemption, as well as in the possible new scenario, without considering the aforementioned exemption. For this part of the study we analyzed the results of the 10 most profitable real estate investment funds, according to the ranking of the Club FII website. The main information included in the financial statements for 2017 was net income, dividend distribution, dividend yield and change from the beginning of the year to the end of the year. The article also explored the possible impact with the use of a questionnaire to investors. It was first concluded that IR taxation on income reduces the investor's profitability by at least 1.31 percentage points. It was also concluded, based on the survey, that 62.5 percent of investors consider the impact as catastrophic if they approve the law in the form of the provisional measure 694.
