The theme here, in essence, is that the major inconsistency explaining the general unification and modern transformation of Malayan Islam is British colonialism itself. While scholars working on Malaysian social change have hinted at this possibility, the author demonstrates it convincingly and in the process contributes significantly to our knowledge of Malaysian institutional development and to a method of exploring such change by way of legal material.

The Politics Of Islamic Law written by Iza R. Hussin and has been published by University of Chicago Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-03-31 with Law categories.

In The Politics of Islamic Law, Iza Hussin compares India, Malaya, and Egypt during the British colonial period in order to trace the making and transformation of the contemporary category of ‘Islamic law.’ She demonstrates that not only is Islamic law not the shari’ah, its present institutional forms, substantive content, symbolic vocabulary, and relationship to state and society—in short, its politics—are built upon foundations laid during the colonial encounter. Drawing on extensive archival work in English, Arabic, and Malay—from court records to colonial and local papers to private letters and visual material—Hussin offers a view of politics in the colonial period as an iterative series of negotiations between local and colonial powers in multiple locations. She shows how this resulted in a paradox, centralizing Islamic law at the same time that it limited its reach to family and ritual matters, and produced a transformation in the Muslim state, providing the frame within which Islam is articulated today, setting the agenda for ongoing legislation and policy, and defining the limits of change. Combining a genealogy of law with a political analysis of its institutional dynamics, this book offers an up-close look at the ways in which global transformations are realized at the local level.

This collection of essays has been prepared as a tribute to Clive S. Kessler, Professor of Sociology at the University of New South Wales for over twenty years and a member of staff of the London School of Economics and Political Science, University of London, and the Barnard College, Columbia University, New York. Written by colleagues and graduate students, the essays are divided into three sections: Islam, Society and Politics. They focus on Professor Kessler's analyses of Malaysia. Each essay draws on aspects of his published research, taking his insights as points of departure for new studies. Professor Kessler's ideas and observations are thus extended, complemented and updated in ways which emphasize the depth and extent of his influence on contemporary research on Malaysia.

Aljunied looks at how Malay states and societies survived under colonial regimes that heightened racial and religious divisions, and how Muslims responded through violence as well as reformist movements. Although there have been tensions and skirmishes between Muslims and non-Muslims in Malaysia, they have learned in the main to co-exist harmoniously, creating a society comprising of a variety of distinct populations. This is the first book to provide a seamless account of the millennium-old venture of Islam in Malaysia.
