Di awal Order Baru umat Islam yang merupakan mayoritas sosiologis tapi menjadi minoritas secara politis, tetapi di akhir Order Baru terjadi keharmonisan antara pihak pemerintah (negara) dengan umat Islam, sehingga muncul beberapa produk hukum yang diklaim sebagai hasil karya umat Islam (‘hukum Islam di Indonesia’), seperti UU No. 1 tahun 1989 tentang Peradilan Agama, Inpres No. 1 tahun 1991 tentang penyebarluasan Kompilasi Hukum Islam (KHI). Keharmonisan tersebut berlanjut di era pasca Order Baru, terutama era pemerintahan transisi, sehingga banyak produk peraturan perundang-undangan yang merupakan representasi aspirasi umat Islam, seperti Undang-Undang No. 35 tahun 1999 tentang pengelolaan Zakat, dan Undang-Undang No. 17 tahun 1999 tentang penyelengaraan ibadah Haji. Politik hukum Islam lebih dipengaruhi oleh pola relasi antara Islam dan Negara. Relasi Islam dan negara yang harmonis akan menghasilkan beberapa produk hukum Islam. Sebaliknya relasi Islam dan negara yang mengalami ketegangan akan sulit untuk menghasilkan produk hukum.
