Um alle relevanten Aspekte der Fragestellung im Detail zu berücksichtigen, lassen sich aus der zentralen Forschungsfrage weitere Forschungsfragen ableiten: Welche wesentlichen Unterschiede ergeben sich aus der neuen Technologie des ICO und des bisher geübten Prozesses des IPO? Inwiefern gibt es zwischen den beiden Verfahren Möglichkeiten zur Substitution oder Ergänzung? Welche Anpassungen müssten aus technischer oder rechtlicher Sicht erfolgen, damit ICOs in der Kapitalmarktberatung angewandt werden können? Speziell bezugnehmend auf die Integration von ICOs in das Corporate-Finance-Geschäft einer Bank soll ein entsprechendes Geschäftsmodell entwickelt werden, wodurch sich folgende weitere Forschungsfragen ableiten lassen: Welche Anforderungsprofile (potenzielle Zielkundensegmente) können mit ICOs bedient werden und was ist die Value Proposition des Geschäftsmodells? Welche Beratungsprozesse oder -leistungen lassen sich für ICOs ableiten? Welche Infrastruktur wird für ICOs benötigt? The most interesting part with the Cryptocurrencies is the creation of a new category of business funding, which is the ICO - Initial Coin Offering. It is amazing how many companies are created in daily basis and trying to secure funding through ICO. They promise that they will solve one of our problems using Blockchain and in return they are giving us tokens for reward. Tokens which can worth 10 or 100 times more in a few years or nothing in a few months. They are excellent articles and books in the market, which explain the difference between utility and security tokens, which market you should invest (online storage, VR, real estate, financial transactions) or which characteristics you need to check to spot a scam ICO (white paper, development and engineering team, marketing, timeline, reputation). Immer mehr Menschen investieren in digitale Assets wie Bitcoin und Ethereum, während auch die Verwendung von Kryptowährungen für den Kauf von Gütern und Dienstleistungen steigt. Die Anerkennung von Bitcoin als gesetzliches Zahlungsmittel in Ländern wie El Salvador zeigt die zunehmende Integration von Kryptowährungen in den Alltag. Diese Entwicklung wurde jedoch von Herausforderungen begleitet, wie beispielsweise der Insolvenz der Kryptobörse FTX und den damit verbundenen Vorwürfen von Betrug und Geldwäsche. This book poses the question: do we need a new body of regulations and the constitution of new regulatory agents to face the evolution of money in the Fourth Industrial Revolution? After the Global Financial Crisis and the subsequent introduction of Distributed Ledger Technologies in monetary matters, multiple opinions claim that we are in the middle of a financial revolution that will eliminate the need for central banks and other financial institutions to form bonds of trust on our behalf. In contrast to these arguments, this book argues that we are not witnessing a revolutionary expression, but an evolutionary one that we can trace back to the very origin of money. Accordingly, the book provides academics, regulators and policy makers with a multidisciplinary analysis that includes elements such as the relevance of intellectual property rights, which are disregarded in the legal analysis of money. Furthermore, the book proposes the idea that traditional analyses on the exercise of the lex monetae ignore the role of inside monies and technological infrastructures developed and supported by the private sector, as exemplified in the evolution of the cryptoassets market and in cases such as Banco de Portugal v Waterlow & Sons. The book puts forward a proposal for the design and regulation of new payment systems and invites the reader to look beyond the dissemination of individual Distributed Ledger Technologies such as Bitcoin.
