La monografia “Diritto penale ed enti collettivi” ha ad oggetto le problematiche che derivano dall’estensione della soggettività penale alle persone giuridiche. Il volume, che si rivolge in primo luogo agli studiosi del diritto penale, ma che riveste un sicuro interesse anche per i cultori del diritto amministrativo e delle scienze economiche, affronta gli aspetti più attuali del rapporto tra diritto sanzionatorio e libertà di impresa, declinati nei tre distinti modelli dell’ente lecito, dell’ente lecito e dell’ente sospetto. La tesi centrale del libro “Diritto penale ed enti collettivi” è che a partire dal 2001, con l’entrata in vigore del d.lgs. 231/01, non solo è stato superato il principio illuministico Societas delinquere non potest, ma è stata altresì abbattuta la tradizionale distinzione tra disciplina dell’ente lecito e reati associativi. Attraverso la progressiva estensione agli enti collettivi delle misure di prevenzione previste nel Codice antimafia e nella legislazione complementare in materia di contrasto alla corruzione, ha infine preso vita una terza categoria, quella dell’ente “sospetto”, nella quale le diverse forme di diritto penale emergenziale finiscono per convergere, creando un evidente contrasto con i principi fondamentali che regolano la libertà di associazione e d’impresa.
