Justitia, die Darstellung der Gerechtigkeit, erscheint heute den meisten von uns im Gewand der juristischen Gerechtigkeit - als Symbol der staatlichen Rechtsprechung und als Versprechen, dass einem vor Gericht Gerechtigkeit widerfährt. Justitia bewegt sich nach diesen Vorstellungen in einem engen Bedeutungskorridor. Ein Blick zurück in die Geschichte offenbart jedoch einen Wahrnehmungsbruch. Justitia war in früheren Epochen nicht nur auf deutlich mehr Bedeutungsinhalte bezogen, sondern auch für mehr Personen und Gruppen Handlungsmaxime und Leitbild als nur für Juristen oder die vor Gericht streitenden Parteien. Besonders der Aspekt der Gerechtigkeit als Tugend der Händler und Leitbild im Warenhandel scheint heute in Vergessenheit geraten zu sein. Obwohl der Ausdruck des "gerechten Kaufmanns" noch heute Verwendung findet, scheint kaum mehr jemand Justitia als die Tugend der Kaufleute zu begreifen. Diese Arbeit geht der Frage nach, wie das Justitia-Bild zu früheren Epochen, insbesondere während der Frühen Neuzeit in der Region des heutigen Ostwestfalen-Lippes, aussah. Sie interessiert sich dafür, wo Justitia aus welchen Gründen auftauchte und was das uns heute über die Menschen und ihre Geschichte erzählt. Auf jeden Fall zeigt sich Justitia als eine allgemeine menschliche Tugend, mit deren Hilfe man sich auch gesellschaftlich positionierte und Machtansprüche artikulierte. Justitia zeigt sich während dieser Epoche als sehr facettenreich. Und dies gilt es wiederzuentdecken und zu verstehen, wenn man die Gegenwart und mögliche Wege in die Zukunft verstehen will.

The immortality of the soul is one of the oldest tropes in the history of philosophy and one that gained significant momentum in 16th-century Europe. But what came before Pietro Pomponazzi and his contemporaries? Through examination of four neglected but central figures, Joanna Papiernik uncovers the rich and varied nature of the afterlife debate in 15th-century Italy. By engaging with old prints, manuscripts and other archival material, this book reveals just how much interest there was in the question of immortality before the 16th-century boom in Aristotelian translations. In particular, Papiernik sheds light on the treatises of Agostino Dati, Leonardo Nogarola, Antonio degli Agli and Giovanni Canali, all of which have until now been overlooked in modern scholarship. From Dati's critiques of ancient and existing positions to Agli's study of immortality and its relation to the metaphysics of light, this volume investigates not only how wide-ranging the debate was but also the important impact it had on later philosophical thinking. Gerechtigkeit sei demnach eine Tugend, derer sich die Juristen vor Gericht bedienen sollten, die der Staat seinen Bürgern verspricht und im Rahmen der Einhaltung der Gesetze auch von ihnen einfordert. Gerechtigkeit erscheint damit an Gesetze gebunden. Justitia kommt erst zum Tragen, wenn Recht gebrochen wurde und Unrecht geschehen ist. Ein Blick in die Geschichte zeigt jedoch schnell, dass sich dieses Bild nicht auf andere Epochen übertragen lässt, dass es das Ergebnis jüngerer Entwicklungen ist. Das Beispiel der Stadt Lemgo während der Frühen Neuzeit offenbart, dass der Gedanke, der mit Justitia verbunden wurde, deutlich vielfältiger und allgemeingültiger war, als sich es die Menschen heute vorstellen würden. Mit der Zeit hat ein Wandel, gar ein Bruch in der Wahrnehmung stattgefunden. Kaum einer wür-de Justitia heute als Tugend der Kaufleute betrachten. Aber als solche zeigt sich die Allegorie der Gerechtigkeit in Lemgo der Frühen Neuzeit. Darüber hinaus erscheint sie als eine Tugend, die alle Lebensbereiche durchdrang, alle Menschen umfasste und weit mehr war, als bloßes Schmuckwerk oder Mittel der Demonstration gerichtlicher Privilegien oder Ansprüche. Sie war nicht nur eine Tugend der Juristen, sondern aller Menschen.

Walter Ullmann's contribution to the study of medieval political and legal thought needs no emphasis. In the present volume are collected a number of the early articles which it was not possible to include in his previous collections, together with others published since those volumes appeared. The articles display a striking consistency of approach, though in the more than forty years separating the earliest from the latest there is an obvious development in his thought. Ullman held the view that the law must be studied in its own historical context, as a function of society and a product of the factors which shaped social life; equally, he stressed the central position of the law in the study of medieval history, for its precise character meant that it could provide a more reliable probe into medieval beliefs and doctrine than any other form of evidence.
