El núcleo central de trabajo que aquí se presenta se corresponde con la teoría de los actos neutrales y su traslación al campo del Derecho penal económico, específicamente, a dos de los delitos que, dotados de sesgo económico, son más paradigmáticos, esto es, el fraude fiscal (art. 305 CP) y el blanqueo de capitales (art. 301 CP), analizando sus características a través de la intervención en éstos de dos operadores jurídicos de suma importancia como son el asesor fiscal y el abogado. Con ello se pretende ofrecer una respuesta lo más clara y concisa posible a la siguiente pregunta: ¿pueden estos profesionales realizar comportamientos de contribución delictiva al delito de un tercero que se sitúen dentro de la esfera del riesgo permitido, esto es, que sean neutrales realizando así un negocio estándar? El abordaje de este interrogante requiere de un análisis que vaya desde las premisas más básicas y específicas de nuestro modelo de intervención delictiva, hasta los elementos más propios y estructurales de la atribución de la responsabilidad penal en ambos tipos penales. Pasando por un fuerte cuestionamiento de qué son, cuál es su alcance y cómo se fundamentan, en sí mismos, los comportamientos neutrales. Así, se propone la elaboración de un juicio de neutralidad que pretende alzarse como una reformulación de la teoría de la imputación objetiva desde una perspectiva intersubjetiva. Esta teoría marco se construirá sobre el reconocimiento de una dualidad de componentes (objetivo y subjetivo), y su finalidad última será de carácter bidireccional, identificándose así con un posicionamiento que permita tanto justificar la exención de responsabilidad penal de los operadores jurídicos, como su castigo. Con ello se pretenderá otorgar una mayor argumentación y coherencia a la valoración de la neutralidad del comportamiento y, en última instancia, al límite mínimo de la intervención punible, siempre desde el prisma de la responsabilidad penal individual. Con la presente obra titulada “Selecciones de Dogmática Penal Latinoamericana” damos inicio a una serie de abordajes en doctrina teórica y aplicada en el derecho penal de la Patria Grande, Latinoamérica, sede máxima de nuestras reflexiones y preocupaciones, por dos motivos principales: En primer lugar, por haber nacido en algunos de los países de Sudamérica, Centroamérica y el Caribe, de habla española o lengua romance. Si bien los intentos de un Código Penal Tipo para Iberoamérica no resultan viables desde el nivel de la jurisdicción propia de una unidad política nacional, al ser Latinoamérica actualmente un conglomerado de países diversos e independientes entre sí, unidos básicamente por lazos de idioma y sistemas sociales con similares características y dificultades, es en el terreno dogmático y doctrinario en donde podemos encontrar las bases de solución para nuestros problemas y conflictos jurídico-sociales, teniendo en cuenta que en el sistema jurídico del civil law la doctrina se constituye como la primera fuente material del derecho, como la cantera de fértiles campos desde la cual se extraen las creaciones y recreaciones conceptuales que iluminan todo el edificio teórico de la dogmática, proyectando su luz cognitiva hacia el sistema jurídico en su integridad, toda vez que las creaciones y/o recreaciones doctrinarias pueden ser acogidas por la legislación, y ésta, al admitir tales creaciones y/o recreaciones, tras ser aplicada por los tribunales de justicia, se puede convertir en jurisprudencia.
