This book analyzes the scope of judicial authority and discretion to recognize the equitable doctrine of unclean hands as a bar to actions seeking damages in the United States. Bringing an American perspective to the contentious conversation about law - equity fusion in other countries of the common law, the book provides a historical, doctrinal, and theoretical account of the defense, analyzes cases in the federal courts and across the fifty states, and places the issue of integration within a broader debate over the fusion of law and equity. The analysis includes descriptive and normative accounts of the equitable maxim of unclean hands. This groundbreaking work, which clarifies conflicting case law and advances the idea of a principled fusion of law and equity, should be read by anyone interested in equity - its cultivation, preservation, and celebration.

Excerpt from The Fundamentals of Live Stock Judging and Selection The progress of the teaching of Animal Husbandry, especially live stock judging and selection, commends this division of the subject to a full modern treatise dealing with all domestic animals. Rapid advancement in special fields of production and selection, and the addition of new phases of animal judging, have furnished much hew material for the work. In developing the subject various viewpoints ranging from that of the extensive live stock breeder to the city fancier must of necessity be considered. Not only the college student and the professional judge, but also the live stock breeder, general farmer, salesman, buyer, and the city fancier of stock at one time or another inspects animals from the standpoint of the critic. He thus becomes the judge whether in the show ring or in the field, and when the term "judge" is referred to in the text it should be understood that it is not specifically used. In certain instances attention may be directed to the student or the professional judge while in other cases any of the above meanings may be inferred. Any individual who selects stock is placed in the position of the judge, specifically speaking, and he should, therefore, be so considered in construing the various discussions herein given. Equity written by Irit Samet and has been published by Oxford University Press, USA this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018 with Law categories.

This book sets out to defend the claim that Equity ought to remain a separate body of law; the temptation to iron-out the differences between neighbouring doctrines on the two sides of the Equity/Common Law divide should, in most cases, be resisted. The theoretical part of the book is argues that the characteristics of Equity, namely, appeal to conscience, flexibility, retroactivity and the use of morally-freighted jargon, are essential for the implementation of a legal ideal that has been neglected by the Common Law: 'Accountability Correspondence'. According to this fundamental legal ideal, liability imposed by legal rules should correspond to the pattern of moral duty in the circumstances to which the rules apply. Equity promotes this ideal in the fields of property and obligations by disallowing parties to exploit the rule-like nature of Common Law norms in a way that breaches their moral duty to the other party. By reference to various equitable doctrines, it is argued that the faults identified by critics of Equity, especially from the perspective of the Rule of Law, are highly exaggerated, and that the criticism often reflects a political belief in the supremacy of individualism and free market over empathy and social justice. The theoretical part is followed by three chapters, each dedicated to an in-depth analysis of the equitable doctrines of fiduciary duties, proprietary estoppel, and clean hands. For each doctrine, it is shown how their equitable characteristics are indispensable for achieving their social, ethical and economic purpose.

Papers from a conference at the Univ. of Kansas, Oct. 1986. The limits of knowledge about language and the acquisition process are plain when attempts are made to help children who need explicit teaching. A study of 260 New York case decisions in which tenured teachers have been charged with incompetence or conduct unbecoming a professional. Gross (labor law and arbitration, NY State School of Industrial and Labor Relations) demonstrates the need for clear and equitable criteria to evaluate teachers. Philosophical Foundations Of The Law Of Equity written by Dennis Klimchuk and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-04-02 with Law categories.

The law of Equity, a latecomer to the field of private law theory, raises fundamental questions about the relationships between law and morality, the nature of rights, and the extent to which we are willing to compromise on the rule of law ideal to achieve social goals. In this volume, leading scholars come together to address these and other questions about underlying principles of Equity and its relationship to the common law: What relationships, if any, are there between the legal, philosophical, and moral senses of 'equity'? Does Equity form a second-order constraint on law? If so, is its operation at odds with the rule of law? Do the various theories of Equity require some kind of separation of law and equity-and, if they do, what kind of separation? The volume further sheds light on some of the most topical questions of jurisprudence that are embedded in the debate around 'fusion'. A noteworthy addition to the Philosophical Foundations series, this volume is an important contribution to an ongoing debate, and will be of value to students and scholars across the discipline.
