"Indian Patent Act 1970" is the governing law related to patent right In India. The law starts from 1911 after the Indian Patents and Designs Act, 1911 enacted in India. The present Patents Act, 1970 and it came into force in the year 1972 after amending and consolidating the existing law relating to Patents in India. The act was again amended by the Patents (Amendment) Act, 2005, where the term patent was extended to every wake of technology may it be food, drugs, chemicals or micro organisms. As a result of amendment, the provisions pertaining to Exclusive Marketing Rights commonly known as EMRs, have been repealed, and a provision for enabling grant of compulsory license has came in practice. At the same time provisions relating to pre and post-grant opposition have been introduced to the whole of the country. The present paper aims at the study of the role of the judiciary in patent protection in India . It also discuss the leading landmark decision in "Novartis v. Union of India & Others"
