A judicialização da política é um fenômeno global, resultante dos deslocamentos da centralidade do poder a partir dos novos paradigmas do Estado de Direito. A figura do exegeta "boca da lei" cedeu lugar para um Poder Judiciário comprometido com as questões políticas da sociedade, em razão das novas configurações sociais. A Constituição de 1988 representou um marco na história democrática brasileira, adotando um extenso rol de direitos e condições estruturais para que o cidadão pudesse exercer a sua autonomia e participar democraticamente na construção das políticas públicas. A par disso, estabeleceu um amplo acesso ao Poder Judiciário e um sistema complexo de judicial review. Os novos arranjos institucionais, contudo, favoreceram uma atitude ativista, contrária à razão pública e aos propósitos democráticos da Constituição. De fato, não existe, atualmente, uma resposta normativa e institucional contra decisões eminentemente políticas proferidas no âmbito do Poder Judiciário, que alteram escolhas válidas, perfeitas pelos demais órgãos e agentes públicos, e que modificam o próprio sentido histórico normativo da Constituição. Essa condição revela a necessidade de se repensar a relação entre os poderes e os instrumentos de interação, para que se possa superar as decisões contrárias à razão pública e garantir as pré-condições necessárias para a realização do valor intrínseco da democracia.

O trabalho de Giovanni Galvão Vilaça Gregório é fruto da inquietação intelectual de quem, imerso na prática judiciária, não deixa de lado os bons fundamentos teóricos que devem conduzir essa prática. O tema é muito atual, e eu diria se tratar de "tema eterno", porque não há ponto final nessa discussão. Giovanni, nesse tom, propõe roteiro seguro para se conhecer o tema e se aprofundar em sua discussão, oferecendo o enriquecimento decorrente das interações entre o Direito e a Política, porque o Poder Judiciário é também examinado sob o viés do Estado Democrático de Direito. Essa perspectiva permite compreender de forma mais aguda os fenômenos da "judicialização da política" e do "ativismo". O autor percorre os temas com elegância de estilo, o que estimula o envolvimento do leitor, não perdendo de vista, em nenhum momento, a íntima relação dos temas trabalhados com a própria ideia de Democracia, na pesquisa pelos limites da "Judicialização da Política" e do "Ativismo Judicial". Sublinhe-se, especialmente, a incursão pelo "Minimalismo Jurídico", de Cass Sunstein, autor não muito divulgado no Brasil (no que tange ao objeto deste trabalho), mas que oferece interessante instrumental teórico para identificar os limites ou contornos, nas palavras de Giovanni, para a postura ativista do Poder Judiciário, em um cenário de intensa judicialização da política.

Impunha-se o tratamento científico da temática da legitimidade do controle judicial sobre as decisões referentes às matérias afeitas a políticas públicas destinadas à realização dos direitos fundamentais. O trabalho, expositivo e analítico, perpassa à análise da formação dos Estados, Constitucionalismo, sendo o Princípio da Separação dos Poderes observado sob ótica crítica, aliada a uma nova visão de separação proposta pela doutrina de vanguarda. Os direitos Humanos e os direitos fundamentais são objeto de diferenciação e análise, uma vez que são os temas centrais de proteção. Da mesma maneira, analisam-se normas programáticas nas Constituições, sobretudo a eficácia que possuem sobre as demais normas do ordenamento jurídico. Com isso, os fenômenos do ativismo judicial e judicialização da política são conceituados e caracterizados ao longo da dissertação, embora tenha sido a eles guardado capítulo próprio, sendo também mencionada a temática dos processos estruturais, em especial, o estado de coisas inconstitucional. O tema também é analisado em cotejo com o mínimo existencial e reserva do possível. A prática é exposta considerando-se casos que surgiram ao longo da pesquisa, com análise das decisões judiciais proferidas. O objeto da conclusão prende-se ao fato de ser possível a intervenção judicial nas políticas públicas para o fim de realização dos direitos fundamentais.

No Brasil, em especial, a discuss�o acerca do ativismo judicial encontra ra�zes no processo de redemocratiza��o que rompeu com o per�odo ditatorial no pa�s, oportunidade na qual � promulgada a Constitui��o Federal (1988). Assim, o presente trabalho pretende fazer uma rela��o (de desconstru��o) entre o movimento consagrado como constitucionalismo contempor�neo e o assentamento de posturas ativistas por parte do Poder Judici�rio, de modo a demonstrar que judicializa��o da pol�tica (da vida e/ou do social) e ativismo judicial s�o fen�menos distintos, e que a aus�ncia de uma robusta distin��o acerca destes fen�menos conduz a um estado d'arte no qual impera o protagonismo judicial, algo que � nocivo para a democracia. Günther's book demonstrates that most objections to moral and legal principles are directed not against the validity of principles but against the manner of their application. If one distinguishes between the justification of a principle and its appropriate application, then the claim that the application of the principle in each individual case follows automatically from its universal justification proves to be a misunderstanding. Günther develops this distinction with the help of Habermas's discourse theory of morality. He then employs it to extend Kohlberg's theory of moral development and to defend this against Gilligan's critique. In the third and fourth parts of the book, Günther shows--in debate with Hare, Dworkin, and others--how argumentation on the appropriate application of norms and principles in morality and law is possible.

Most people think that the Supreme Court has a rough balance between left and right. This is a myth; in fact the justices once considered right-wing have now taken the mantle of the Court's moderates, and the liberal element has all but disappeared. Most people also think that judicial activism is solely a liberal movement.
