Entmün digt ist der Geisteskra.nke nicht, obgleich alle ge setzlichen Voraussetzungen hiefür vorliegen. Die Angehörigen wünschen auch eine solche Entmundigung nicht, möchten auch womoglich eine so eingreifende Aufsichts und Fursorgethatig keit, wie sie eine Vormundschaft mit sich bringt, sowohl im Hinblick darauf vermieden wissen, dass schon bisher die An gelegenheiten des Kranken von ihnen anstandslos besorgt worden sind, als auch deshalb, weil eine Behelligung desselben im Interesse der Hintanhaltung von Aufregungen nicht wün sehenswert ist. Was ist da zu tun? Was sollen die Ange hörigen bei Gericht beantragen, wozu wird ihnen der Arzt raten? Die juristischen Schriftsteller sind hier geteilter An sicht. Die einen halten dafür' dass in einem solchen Fall nur Entmundigung und Vormundschaft rechtlich möglich und zu lässig sei, da. Es sich um einen zur Entmündigung reifen dauernd Geisteskranken handelt. Die andern dagegen halten in einem solchen Fall die Herbeiführung der Entmundigung und die Einleitung einer Vormundschaft nicht für erforderlich und vom Gesetz geboten, sondern sie halten es für zulässig, dass ledig lich eine Pflegschaft und zwar nur für die einzelne Angelegen heit, um deren Besorgung es sich gerade handelt, eingeleitet wird. Dieser letzteren Ansicht hat sich die Rechtsprechung der hoheren Gerichte und neuerdings auch das Reichsgericht in einer Entscheidung vom 6. Oktober 1902 angeschlossen. Der vom Reichsgericht entschiedene Fall war folgender: Ein Ehemann wollte gegen seine geisteskranke Ehefrau die Klage auf Scheidung der Ehe wegen Geisteskrankheit erheben. Die Geisteskrankheit der Frau war eine solche, dass sie infolge derselben nicht bloss zur Besorgung einzelner ihrer Angelegen heiten, sondern zur Besorgung der Gesamtheit ihrer Ange legenheiten unfähig war. Es lagen also die Voraussetzungen für eine Entmündigung wegen Geisteskrankheit vor. Der Ehe mann hatte bei dem Vormundschaftsgericht die Bestellung.
