The Max Planck Handbooks in European Public Law series describes and analyses the public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, it aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series begins this enterprise with an appraisal of the evolution of the state and its administration, with cross-cutting contributions and also specific country reports. While the former include, among others, treatises on historical antecedents of the concept of European public law, the development of the administrative state as such, the relationship between constitutional and administrative law, and legal conceptions of statehood, the latter focus on states and legal orders as diverse as, e.g., Spain and Hungary or Great Britain and Greece. With this, the book provides access to the systematic foundations, pivotal historic moments, and legal thought of states bound together not only by a common history but also by deep and entrenched normative ties; for the quality of the ius publicum europaeum can be no better than the common understanding European scholars and practitioners have of the law of other states. An understanding thus improved will enable them to operate with the shared skills, knowledge, and values that can bring to fruition the different processes of European integration.

This research delivers a conceptual reconstruction of the trajectory of concepts used to mark qualitative differences among identities from the 16th to the 21st century in central Europe and the Americas. The surplus lies in the inclusion of colonial history in the genealogy of Western political thought and ideas, as well as in the postcolonial discussion of multiculturalism. The manuscript deals with the power and authority of translation providing the reader with an insight into the history of colonial racism through a deep conceptual analysis of three historical debates that have not been previously discussed together. By linking the so-called “Indian Question”, the “Jewish Question” and the multicultural question, this thesis includes a valuable critical revision of the origins of Humanism in colonial times and contexts and an original critique to the power and violence of language in ma(r)king differences, which is described in terms of translation. This thesis was selected among the three best dissertations in critical social thinking of the year 2019 by the Rosa Luxemburg Stiftung.

L’actualité regorge malheureusement d’exemples de crimes contre l’humanité, de génocides, d’actes de piraterie maritime, de prises d’otages et autres crimes de terrorisme international, à travers le monde. Ces crimes sont souvent englobés sous le qualificatif de « crimes internationaux » alors même qu’ils correspondent à des actes et à des régimes juridiques très différents. L’objectif de cet ouvrage est d’analyser les interactions normatives entre droit international et droits pénaux étatiques afin de démontrer que coexistent deux processus normatifs différents - l’internationalisation du droit pénal interne et la pénalisation du droit international. Ces processus ont donné naissance à deux corpus de droit relevant d’ordres juridiques différents : – le droit pénal international réglementant les crimes transnationaux (dont la piraterie maritime, le détournement d’avion, le financement du terrorisme ou encore la corruption internationale) – le droit international pénal encadrant les crimes supranationaux (limités pour l’heure au crime d’agression, au génocide, au crime contre l’humanité et aux crimes de guerre les plus graves). Les premiers sont dits transnationaux car dépassant les frontières étatiques, ils ont fait l’objet de conventions internationales de coopération pénale visant à renforcer l’efficacité de leur prévention et répression. Ils demeurent néanmoins des crimes de droit commun incriminés par les droits pénaux internes et jugés par les seules juridictions nationales. Les seconds sont qualifiés de supranationaux parce qu’ils constituent des violations graves de normes fondamentales du droit international et sont directement encadrés par le droit international, indépendamment des droits pénaux nationaux. Leur régime juridique présente des spécificités propres, à commencer par la compétence de juridictions pénales internationales pour en juger. L’originalité ici sera d’étudier ensemble ces deux aspects, de présenter les régimes juridiques associés à chaque type de crimes internationaux et d’étudier les évolutions de la société internationale tout à la fois qu’ils expliquent et auxquelles ils donnent lieu.
