A conciliação com o Ente Público é possível diante das penalidades constantes no Código de Trânsito Brasileiro, quando a punição de proprietários de veículos e condutores ocorre de forma indevida, punindo sumariamente aqueles que não sejam efetivamente os condutores responsáveis. Visando garantir o direito à locomoção e ao acesso à justiça, a Carta Magna de 1988 assegurou, por meio do art. 5o, incisos XV e XXXV, que o Poder Judiciário irá garantir o direito à locomoção e apreciar lesão ou ameaça a direito. Na busca pela correção de distorções quanto a aplicação de penalidades sumárias à CNH dos proprietários e condutores, o Poder Judiciário passa a apreciar pedidos de proprietários de veículos, objetivando a correção do cadastro de pontos decorrentes de multas de trânsito cadastradas sumariamente na CNH do proprietário, quando não tenha ocorrido a identificação do condutor no momento da autuação, visando a readequação da situação ao real condutor. Com o avanço do Constitucionalismo, o acesso à justiça, além de ser exercido pelas partes ao acessarem o Poder Judiciário, passa a reclamar pelo necessário debate sobre uma maior brevidade quanto à resposta do Estado Julgador em relação ao bem pretendido pela prestação jurisdicional vindicada, almejando pela resposta enquanto útil, em especial no caso de aplicação de penalidades restritivas de direitos que recaiam sobre o direito de conduzir veículos, que limitam a locomoção regular por parte do cidadão. O trabalho foi desenvolvido por meio de pesquisa bibliográfica e análise de julgados do STJ, com base em fontes especializadas, indicando a fundamentação dominante sobre o tema. A efetiva punição dos condutores, consoante às disposições do Código de Trânsito Brasileiro, deve ser feita observando as normas previstas na Constituição Federal de 1988, que garantem a todos o acesso à justiça, que será efetivado com o intento de ações judiciais e com o desfecho destas de forma mais célere, com a participação dos integrantes do processo, mediante atuação mais dinâmica, buscando a conciliação pelas partes, incluindo o Poder Público, nos casos em que houver autorização para tanto.

This book provides a fascinating analysis of a single jurisdiction, Brazil, and accounts for both the successes and the failures of its most recent constitutional project, inaugurated by the Constitution of 1988. It sets out the following aspects of the constitutional development and erosion: - the different phases of the promised transition from military rule to a 'social-democratic constitutionalism'; - the obstacles to democratisation derived from the absence of true institutional reforms in the judicial branch and in the civil-military relationship; - the legal and social practices which maintained a structure that obstructed the emergence of an effective social-democracy, such as the neoliberal pattern, the acceptance in the political field of unlawful organisations, such as the milícias, and the way the digital revolution has been harming the formation of democratic sovereignty. Situating Brazil in the global context of the revival of authoritarianism, it details the factors which are common to the third wave of democratisation reflux. Accounting for those aspects, particular to the Brazilian jurisdiction, it shows that there is a tension in the Brazilian constitution. On the one hand, such constitutionalism was renewed by democratic pressure on governments to undertake social politics since 1988. On the other hand, it retained authoritarian practices through the hands of diverse institutions and political actors. By exploring the ideas of constitutional erosion and collapse, as well as democratic, social and digital constitutionalism, the book presents a comparative analysis of Brazil and other jurisdictions, including the United States, South Africa, and Peru.
