La nueva teoría del constitucionalismo contemporáneo se manifestó, principalmente, en el proceso de constitucionalización del derecho, el cual implica que la Constitución impregna con sus valores y contenidos todos los ámbitos del derecho y de la vida social. The volume gathers theoretical contributions on human rights and global justice in the context of international migration. Los temas sobre los que trata este texto son problemas que no pueden dejar de interesarnos a todos. La importancia de abordar de modo específico las cuestiones implicadas en los periodos de transición desde la perspectiva de la justicia radica en que las violaciones generalizadas y sistemáticas de derechos no sólo afectan a las víctimas directas sino al conjunto de la sociedad, que tiene que ser capaz de enfrentarlas reformando las instituciones que o bien estuvieron implicadas en su comisión o fueron incapaces de impedirlas. La base de una Justicia de transición ha de ser una teoría de la democracia y los derechos que se oriente a la reconstrucción institucional y social. Pero, además, en su base está el requerimiento de que los responsables rindan cuentas, que los hechos pasados sean conocidos y las víctimas auxiliadas. Y ello porque difícilmente se puede consolidar una democracia de calidad sobre la base del silencio y la impunidad. En esa tensión permanente entre los fines plurales de la reforma institucional y la restauración del imperio de la ley, la reconciliación social, la retribución y el castigo a los ejecutores, el derecho a la verdad y la reparación se debate una aproximación a la justicia asociada a periodos de cambio.
