"La investigación contenida en este libro tiene por objeto un elemento de la juridicidad que no puede dejar de considerarse característico y esencial: la obligatoriedad de las normas y de los ordenamientos jurídicos. Como se verá en las páginas que siguen, las teorías generales del Derecho hoy dominantes no parecen ofrecer una solución satisfactoria a aquella cuestión, que suelen reenviar de modo más o menos explícito a la competencia de las investigaciones metacientíficas. Y aunque con ello se reconoce implícitamente la imposibilidad de romper el vínculo de continuidad cognoscitiva entre ciencia jurídica e investigación filosófica, se deja sin embargo imprecisa la identificación de lo que permite distinguir el derecho y, en general, la experiencia jurídica, de otras formas de prescripción y reglamentación ordenadora del comportamiento humano. La cuestión no atañe sólo a quien considere el Derecho desde el punto de vista filosófico, sino también al jurista positivo, cuyo trabajo, de otro modo, versaría acerca de un objetivo con contornos mal definidos o definidos de manera sólo convencional y, por tanto, siempre discutibles, o bien estaría constreñido a reducirse a un ejercicio estrechamente exegético que contradice las mejores tradiciones de la ciencia jurídica, sea o no moderna". Reprint of the first American edition. One of the most interesting jurists of the post-World War II era, Ross [1899-1979] was a legal and moral philosopher, scholar of international law and the leading representative of Scandinavian Legal Realism. This book and On Law and Justice (1958) are his principal works. In Directives and Norms Ross asks whether imperatives (or, to use his term, 'directives') are subject to logic in the same way as indicatives. He shows the difference between indicative and directive discourse and explains the concepts 'directive' and 'norm' as they function in the social sciences, especially in the study of law. A contemporary essay in the Modern Law Review (32:544), though critical of this work, was still impressed by its "clear and convincing account" of these processes.
