'Insurrectionist Ethics' is the name given to denote the myriad forms of justification for radical social transformation in the interest of freedom for oppressed people. It is a set of advocacy systems that usually aim at liberation for specified populations under siege in a given society. While the identities of these beleaguered groups is always intersectional, one salient criterion of group membership is often chosen to be the rallying point for solidarity. Whether the movement is “Black Lives Matter, “Gay Pride”, or “Poor People’s Campaign,” at the nucleus of each is a cry for emancipation. The contributions in this volume put forward bold, forcefully argued, provocative claims that challenge in a fundamental and radical way the presuppositions, values, and beliefs that underwrite the systems and structures that insurrectionist ethics calls into question. The volume begins with a section defining and theorizing what insurrectionist ethics is, and then moves to a section studying insurrectionist ethics across the Americas. On January 6, 2021, white supremacists, Christian nationalists, and other supporters of President Donald Trump stormed the US Capitol in an attempt to overturn the results of the 2020 presidential election. The insurrection was widely denounced as an attack on the Constitution, and the subsequent impeachment trial was framed as a defense of constitutional government. What received little attention is that the January 6 insurrectionists themselves justified the violence they perpetrated as a defense of the Constitution; after battling the Capitol police and breaking doors and windows, the mob marched inside, chanting “Defend your liberty, defend the Constitution.” In Real Americans: National Identity, Violence, and the Constitution Jared A. Goldstein boldly challenges the conventional wisdom that a shared devotion to the Constitution is the essence of what it means to be American. Civil disobedience is a form of protest with a special standing with regards to the law that sets it apart from political violence. Such principled law-breaking has been witnessed in recent years over climate change, economic strife, and the treatment of animals. Civil disobedience is examined here in the context of contemporary political activism, in the light of classic accounts by Thoreau, Tolstoy, and Gandhi to call for a broader attitude towards what civil disobedience involves. The question of violence is discussed, arguing that civil disobedience need only be aspirationally non-violent and that although some protests do not clearly constitute law-breaking they may render people liable to arrest. For example, while there may not be violence against persons, there may be property damage, as seen in raids upon animal laboratories. Such forms of militancy raise ethical and legal questions. When and why did international law begin to oppose war? For centuries, sovereignty implied the right to wage war. Yet over the past hundred years, a remarkable succession of treaties, courts, and organisations sprang to life that sought to prohibit war. From a fringe ambition, the ideal of ‘peace through law’ became the foundation of international law. This book traces part of this evolution back to the small peace movement of the early nineteenth century, recounting how the earliest organised pacifists built their legal case against war.
