Über das Entstehen eines unselbständigen Verwertungsverbots entscheidet die neuere Rechtsprechung ebenso wie die herrschende Literatur regelmäßig durch eine einzelfallbezogene Abwägung, bei der das staatliche Interesse an der Strafverfolgung im Einzelfall gegen das Individualinteresse des Beschuldigten auf Wahrung seiner Rechte abgewogen wird. Obwohl damit letztlich eine Abwägung zwischen den Grundrechten des Beschuldigten einerseits und dem Grundsatz effektiver Strafrechtspflege andererseits stattfindet, ist die unmittelbar verfassungsrechtliche Verankerung der Verwertungsverbote bisher nicht hinreichend deutlich herausgearbeitet worden. Weitgehend ungeklärt ist zudem, ob und wie ein für den Beschuldigten bestehendes Verwertungsverbot gegenüber Mitbeschuldigten oder Dritten wirkt. Die grundrechtliche Verankerung der Verwertungsverbote und die ebenfalls vor ihrem verfassungsrechtlichen Hintergrund zu erörternde Frage nach ihrer »Drittwirkung« sind daher Gegenstand dieser Untersuchung.

Current interactional linguistic research appears to be crystallizing around systematic themes, which are all represented in this collection of papers. In the first section, where the relation between language and interaction is viewed from the perspective of language structure, several articles deal with the potential of a single structure for both turn and sequence construction, revealing a play-off between planned and occasioned syntax with potentially far-reaching consequences for language development. Other articles deal with lexical expressions as resources for the conduct of interaction, showing how they are heavily dependent on turn position and sequential context for their meaning potential. In the second section, with a view from the perspective of the interactional order, a systematic focus of interest lies on three different conversational tasks: projecting turn and turn-unit completion, starting up turns with 'non-beginnings' and self-repairing. The cross-linguistic studies here all agree that common interactional tasks may well be carried out by quite different linguistic practices and that these practices are dependent to a certain extent on language features which are typologically distinct.

From the master of "micro-history" a reconstruction of two contrasting early-modern thinkers Nevertheless comprises essays on Machiavelli and on Pascal. The ambivalent connection between the two parts is embodied by the comma (,) in the subtitle: Machiavelli, Pascal. Is this comma a conjunction or a disjunction? In fact, both. Ginzburg approaches Machiavelli's work from the perspective of casuistry, or case-based ethical reasoning. For as Machiavelli indicated through his repeated use of the adverb nondimanco ("nevertheless"), there is an exception to every rule. Such a perspective may seem to echo the traditional image of Machiavelli as a cynical, "machiavellian" thinker. But a close analysis of Machiavelli the reader, as well as of the ways in which some of Machiavelli's most perceptive readers read his work, throws a different light on Machiavelli the writer. The same hermeneutic strategy inspires the essays on the Provinciales, Pascal's ferocious attack against Jesuitical casuistry. Casuistry vs anti-casuistry; Machiavelli's secular attitude towards religion vs Pascal's deep religiosity. We are confronted, apparently, with two completely different worlds. But Pascal read Machiavelli, and reflected deeply upon his work. A belated, contemporary echo of this reading can unveil the complex relationship between Machiavelli and Pascal - their divergences as well as their unexpected convergences.
