Das Schwergewicht der deutschsprachigen Kartelliteratur der letzten 20 Jahre lag auf der Behandlung der gesamtwirtschaftlichen Problematik der Kartelle. Betriebswirtschaftlich ausgerichtete Abhandlungen zur Kartellfrage finden sich lediglich vereinzelt Uber Spe zialprobleme, was im Hinblick darauf, daß sich die Kartelle während des zweiten Welt krieges von privatwirtschaftlich orientierten und organisierten Unternehmerzusammen schlüssen zu Lenkungsorganen der staatlichen Wirtschaftspolitik wandelten und nach Kriegsende die Kartelle in Deutschland Uberhaupt verboten waren, verständlich erscheint. Der starke Einfluß der kartellfeindlichen amerikanischen Wirtschaftsauffassung und Wirt schaftspolitik auf die im Grund eher kartellfreundliche Mentalität in den wichtigsten Wirtschaftsländern Europas löste hingegen heftige Diskussionen Uber die zweckmäßigste Gestaltung der staatlichen Kartellpolitik aus, die in einer Reihe von Ländern in Kartell gesetzen ihren Niederschlag fanden; insbesondere in der Deutschen Bundesrepublik ent-· wickelte sich diese Frage in den letzten Jahren zu einern Zentralproblern der Wirt schaftsverfassungspolitik. Es steht wohl außer Zweifel, daß die BlUtezeit des Kartellwesens, die in die ersten drei Jahrzehnte des 20. Jahrhunderts fällt, vorUber ist. Die allgemeinen wirtschaftlicqen Voraussetzungen und Auffassungen sowie die wirtschaftlichen und politischen Macht verhältnisse haben sich in der Zwischenzeit zu sehr gewandelt. Auch dürfte die zu nehmende wirtschaftliche Zusammenarbeit der europäischen Staaten einer Kartellbil dung Grenzen setzen.

The book deals with the expansion and institutionalization of intellectual property norms in the twentieth century, with a European focus. Its thirteen chapters revolve around the transfer, adaptation and the ambivalence of legal transplants in the interface between national and international projects, trends and contexts. Cartels, trusts and agreements to reduce competition between firms have existed for centuries, but became particularly prevalent toward the end of the 19th century. In the mid-20th century governments began to use so called ‘cartel registers’ to monitor and regulate their behaviour. This book provides cases studies from more than a dozen countries to examine the emergence, application and eventual decline of this form of regulation. Beginning with a comparison of the attitudes to regulation that led to monitoring, rather than prohibiting cartels, this book examines the international studies on cartels undertaken by the League of Nations before World War II. This is followed by a series of studies on the context of the registers, including the international context of the European Union, and the importance of lobby groups in shaping regulatory outcomes, using Finland as an example. Section two provides a broad international comparison of several countries’ registers, with individual studies on Norway, Australia, Japan, Germany, Sweden and the Netherlands. After examining the impact of registration on business behaviour in the insurance industry, this book concludes with an overview of the lessons to be learnt from 20th century efforts to regulate competition. With a foreword by Harm Schroter, this book outlines the rise and fall of a system that allowed nations to tailor their approach to regulating competition to their individual circumstances whilst also responding to the pressures of globalisation that emerged after the Second World War.
