In this work, the author demonstrates how the most influential European power and guarantor of the Treaties of Versailles and Locarno replied to the Nazi threat in the heart of Europe. What role did international law play in the response to the swift abolition of democracy and the persecution of Germany's Jews? This study provides fascinating insights into how the international community reacted to Germany's discrimination of Jews in the early years of the Third Reich. Philipp Mohr analyzes a wide array of unpublished documents from the British cabinet, the Foreign Office, the German Auswartiges Amt, and private papers as well as the discussions held by the British parliament and the opinions of the British press in order to ascertain the British state of mind regarding the emerging Nazi dictatorship. The author also describes the discussions of the Council of the League of Nations in regard to the discrimination of the Jews in Germany. Am Beispiel Grossbritanniens beantwortet Philipp Caspar Mohr die Frage, wie der bedeutendste Garant der europaischen Friedensordnung nach dem Ersten Weltkrieg und der Vertrage von Versailles und Locarno politisch und volkerrechtlich auf die 'Machtergreifung' der Nationalsozialisten reagierte.Der Autor setzt sich mit einem hochinteressanten und wichtigen Stuck volkerrechtlicher Zeitgeschichte auseinander. Die Frage, wie die organisierte Volkerrechtsgemeinschaft und die sie tragenden europaischen Grossmachte auf die Diskriminierung bestimmter Menschengruppen reagiert oder nicht reagiert haben, ist bis heute aktuell geblieben. Philipp Caspar Mohr analysiert eine Vielzahl bislang unveroffentlichter Dokumente aus dem Foreign Office, dem Auswartigen Amt und privaten Unterlagen, z. B. der britischen Botschafter in Berlin. Unter Berucksichtigung der Meinungsbildung in der britischen Regierung, im Parlament und in der Presse arbeitet er heraus, wie Grossbritannien auf die Ereignisse im Deutschen Reich reagierte. Dabei wird das damals in Lehre und Praxis vertretene Volkerrecht in kritischer Ruckschau ausgebreitet. Insbesondere setzt er sich auseinander mit dem Rechtsinstitut der 'humanitaren Intervention', dem Minderheitenrecht der Zwischenkriegszeit und mit den Diskussionen im Volkerbundrat uber die deutsche Judenpolitik aufgrund einer Minderheitenbeschwerde aus Oberschlesien.

In the 1930s, Carl Goerdeler, the mayor of Leipzig and, as prices commissioner, a cabinet-level official, engaged in active opposition against the persecution of the Jews in Germany and in Eastern Europe. He did this openly until 1938 and then secretly in contact with the British Foreign Office. Having failed to change Hitler's policy against the Jews, Goerdeler joined forces with military and civil conspirators against the regime. He was hanged for treason on 2 February 1945. This book describes the actions of Carl Goerdeler, the German resistance leader who consistently engaged in efforts to protect the Jews against persecution. Using new evidence and thus far under-researched documents, including a memorandum written by Goerdeler at the end of 1941 with a proposal for the status of the Jews in the world, the book fundamentally changes our understanding of Goerdeler's plan and presents a new view of the German resistance to Hitler.

Lässt sich der Einsatz militärischer Gewalt zum Schutz der Menschenrechte innerhalb fremder Staaten rechtfertigen? Die Arbeit beleuchtet die Frage nach der Rechtfertigung humanitärer Interventionen. Dazu werden Interventionsargumente in der Geschichte des politischen Denkens ausgehend von Wurzeln in Antike und Mittelalter über die Kriegsethik der spanischen Spätscholastik, das politische Denken der Neuzeit bis zur Kritik jeglicher Form von Interventionen vor dem Hintergrund der Dominanz des Souveränitätsprinzips im politischen Denken des 18. Jahrhunderts rekonstruiert. Vor diesem Hintergrund argumentiert der Autor dafür, dass die Souveränität der Staaten nicht unabhängig vom Schutz der grundlegenden Menschenrechte ihrer Bürger gedacht werden kann. Staaten haben eine primäre Verantwortung für den Schutz ihrer Bürger, die, wenn der einzelne Staat sie nicht erfüllt, als sekundäre Verantwortung auch der Staatengemeinschaft als Schutzverantwortung (responsibility to protect) zukommt und militärische Interventionen im Falle massiver Menschenrechtsverletzungen als letztes Mittel erlaubt.
