Dazu wird betrachtet, welche Voraussetzungen erfüllt sein müssen, damit sich ein Kind positiv entwickeln kann und, welche gesetzlichen Regelungen und Maßnahmen es gibt, um das Wohlergehen von Kindern zu schützen. Weiterhin wird anhand aktueller Daten und Statistiken ein Einblick in die gegenwärtige Lebenssituation von Kindern in Deutschland gewährt sowie Ursachen und Folgen von Kindesmisshandlungen dargestellt. In diesem Zusammenhang wird kurz auf relevante Inhalte aus dem KJHG, dem BKiSchG und internationalen Vereinbarungen zum Schutz der Kinder eingegangen. Zum Abschluss wird ein Ausblick auf mögliche weitere Schritte zur Erreichung eines umfassenden und sicheren Schutzes des Kindeswohls gegeben. Dass Kinder schutzwürdige und rücksichtsvoll zu behandelnde Individuen sind, ist allein schon an ihrer körperlichen Gestalt sofort erkennbar. Diese Einsicht ist allgemein akzeptiertes und vorauszusetzendes Gedankengut und spiegelt sich in vielen Gesetzen, Initiativen und Einrichtungen der Kinderfürsorge sowie in den allgemein üblichen Verhaltensweisen gegenüber Kindern wider. Leider gibt es aber auch in kontinuierlich hoher Zahl Fälle von Kindesvernachlässigungen, -missbrauch oder sogar -tötung, im familiären und außerfamiliären Umfeld. Diese traurige Tatsache macht es in unserem Land immer noch erforderlich Maßnahmen zum Schutz der Kinder zu entwickeln und durchzusetzen. English summary: The Child Welfare Convention of the United Nation contains extensive human rights guarantees for minors and adjudication over the concerns of children whose well-being is considered a priority. Also, the child is acknowledged in constitutional law as a bearer of basic and human rights but much remains unclear in the details: can a child exercise their rights themselves or must third parties exercise these rights for their benefit? Does a child derive autonomous decision-making powers from law or is having a right for a child synonymous with claims of protection and assistance through another? Friederike Wapler pursues these questions from the perspective of both public law and theoretical jurisprudence and in the center of the study stands a theory of the dynamic development of a childs potential self-determination, in which a right is given to the child concerning the appropriate decisions over its conditions in each period of its life, which are made in light of their individual interests. Der unbestimmte Rechtsbegriff des Kindeswohls dient nicht nur als Eingriffslegitimation des Staates bei Gefährdungslagen, sondern wird auch zum Entscheidungsmaßstab. Immer wieder aufs Neue muss er mittels richterlicher Entscheidungen konkretisiert werden – sei es zur Begründung und Ausgestaltung des Sorgerechts oder zur Erfüllung des staatlichen Kinderschutzauftrages. In all diesen Phasen treffen unterschiedliche Interessen und Funktionen aufeinander, um das Beste für das Kind zu erreichen. Der Autor analysiert die daraus resultierenden Besonderheiten für das Kindeswohl. Sein Fazit: Um das gesetzliche Kindeswohlprinzip optimal erfüllen zu können, müssen strukturelle Änderungen in kindschaftsrechtlichen Verfahren sowie beim beruflichen Zugang zu diesen in Kraft treten. The undefined German legal term "Kindeswohl" ("the best interest and welfare of the child") not only serves as a legitimization of the state to intervene when a child is in a dangerous situation but also serves as a measuring scale for decisions. Often, the term has to be concretised with the help of legal decisions – both for the support and fulfilment of custody and for guaranteeing the child's well-being by the state. In all these steps different interests and functions collide in order to find the best solution for the child. The author analyses the resulting peculiarities for the best interest and welfare of the child. His conclusion is as follows: In order to fulfil the legal principle for the best interest and welfare of the child, structural changes in processes concerning the law of parent and child as well as the professional access to these must come into force.

This report presents findings from the National Violence Against Women (NVAW) Survey on the extent, nature, and consequences of intimate partner violence in the United States. The National Institute of Justice and the Centers for Disease Control and Prevention cosponsored the survey through a grant to the Center for Policy Research. The survey consists of telephone interviews with a nationally representative sample of 8,000 U.S. women and 8,000 U.S. men about their experiences as victims of various forms of violence, including intimate partner violence. The survey compares intimate partner victimization rates among women and men, specific racial groups, Hispanics and non-Hispanics, and same-sex and opposite-sex cohabitants. It also examines risk factors associated with intimate partner violence, the rate of injury among rape and physical assault victims, injured victims' use of medical services, and victims' involvement with the justice system. Research on intimate partner violence has increased dramatically over the past 20 years. While greatly enhancing public awareness and understanding of this serious social problem, this research has also created much controversy and confusion. Findings of intimate partner victimization vary widely from study to study. Some studies conclude that women and men are equally likely to be victimized by their partners, but others conclude that women are more likely to be victimized. Some studies conclude that minorities and whites suffer equal rates of intimate partner violence, and others conclude that minorities suffer higher rates. In addition, there are many gaps in the scientific literature on intimate partner violence, such as the level of violence committed against men and women by same-sex intimates. Little empirical data exist on the relationship between different forms of intimate partner violence, such as emotional abuse and physical assault. Finally, little is known of the consequences of intimate partner violence, including rate of injury and victims' use of medical and justice system services. This Research Report addresses these and other issues related to intimate partner violence. The information presented in this report is based on findings from the National Violence Against Women (NVAW) Survey, a national telephone survey jointly sponsored by the National Institute of Justice (NIJ) and the Centers for Disease Control and Prevention (CDC). The survey, which was conducted from November 1995 to May 1996, consists of telephone interviews with a representative sample of 8,000 U.S. women and 8,000 U.S. men. Survey respondents were queried about their experiences as victims of various forms of violence, including rape, physical assault, and stalking by intimate partners. Victimized respondents were asked detailed questions about the characteristics and consequences of their victimization, including the extent and nature of any injuries they sustained, their use of medical services, and their involvement with the justice system. This Research Report also summarizes the survey's findings on victimization rates among women and men, specific racial groups, Hispanics and non-Hispanics, and opposite-sex and same-sex cohabitants. It examines risk factors associated with intimate partner violence, rates of injury among rape and physical assault victims, injured victims' use of medical services, and victims' involvement with the justice system. Although this report focuses on women's and men's experiences as victims of intimate partner violence, complete details about men's and women's experiences as victims of rape, physical assault, and stalking by all types of assailants are contained in earlier NIJ and CDC reports. Because of the sensitive nature of the survey, state-of-the-art techniques were used to protect the confidentiality of the information being sought and to minimize the potential for retraumatizing victims of violence and jeopardizing the safety of respondents.
