Nicht nur für die Boulevardpresse war die Tatsache, dass die Kinder und Eltern dem Jugendamt häufig bekannt waren, ein gefundenes Fressen. Am 1.11.2006 titelte die Berliner Zeitung: 'Kevin - auf dem Amtsweg verstorben'. Der zweijährige Kevin wurde am 10. Oktober 2006 tot im Kühlschrank der Wohnung seines Stiefvaters in Bremen aufgefunden. Nach umfangreichen Untersuchungen, heisst es im Artikel, sei der größte Fehler den Behörden zu attestieren. Die Entscheidung, 'Kevin zunächst bei der Mutter und Bernd K. zu lassen, obwohl deren familiäre, psychische und soziale Vorgeschichte ausreichend bekannt gewesen sei' (Otto; 2006; S.2), sei falsch gewesen. 'Beide waren drogen- und alkoholabhängig, beide hatten wegen diverser Straftaten mehrjährige Haftstrafen hinter sich. Laut Bericht war die Polizei mehrfach in die Wohnung gerufen worden, weil die betrunkene Mutter unfähig war, sich um das Kind zu kümmern.'(ebd.) Nicht aus Kostengründen habe man sich gegen Kevins Unterbringung im Heim entschieden. 'Maßstab aller Dinge waren die Wünsche und Interessen der Eltern' (ebd.), heisst es weiter. Besonders fatal scheint dies, angesichts der Tatsache, dass gegen Bernd K. im Zusammenhang mit dem ungeklärten Tod der Mutter ermittelt wurde. Auch als Kevin nach dem Tod der Mutter einen Vormund erhielt, da ihm Ärzte einen 'sehr erbärmlichen' (ebd.) Zustand bescheinigten, gab es nie weitreichendere Konsequenzen. (...)

The legal status of lesbian, gay, bisexual, and transgender (LGBT) people has undergone significant changes in several countries, but remains highly complex and difficult for those affected. Although same-sex partners may have the right to marry or enter into a registered partnership in one Member State, this right may be denied when they exercise their right to freedom of movement. The same is true for certain parent-child relationships, which may be recognized as such in one Member State but not another. This book explores the challenges and controversies concerning the recognition of non-heterosexual relationships throughout the EU through the lens of EU legislation, the case law of the CJEU and ECtHR, and recent national developments. Following the Irish referendum and the recent ECtHR judgment in Oliari v. Italy, more changes are expected in the near future. The opening part of this book describes the current state of play in all EU Member States (and beyond) when formalizing a same-sex relationship, 'steady progress' being the key term in describing the developments in many countries (with the exception of six Eastern European States that object to legislation in this field). The second part concentrates on parenthood and children's rights, notably adoption, surrogacy, multiple parenting, and the range of parenting rights for same-sex couples, and transsexual and transgender people. The third section on gender identity and human rights, discusses the legal aftermath of the European Court of Human Rights' judgment in Oliari, condemning Italy for failing to protect homosexuals' right to family life. Furthermore, it explains European Union legislation against discrimination on grounds of sexual orientation, and the challenges lesbian, gay, bisexual and transgender applicants are confronted with when reaching Europe as refugees. The book ends with a lively debate on the right to change one's legal gender, and it raises the fundamental question of whether we still need gender as a legal category or whether laws concerning partnership and parenting could feasibly be de-gendered. This volume explores the ethics of making or expanding families through adoption or technologically assisted reproduction. For many people, these methods are separate and distinct: they can choose either adoption or assisted reproduction. But for others, these options blend together. For example, in some jurisdictions, the path of assisted reproduction for same-sex couples is complicated by the need for the partner who is not genetically related to the resulting child to adopt this child if she wants to become the child's legal parent. The essays in this volume critically examine moral choices to pursue adoption, assisted reproduction, or both, and highlight the social norms that can distort decision-making. Among these norms are those that favour people having biologically related children ('bionormativity') or that privilege a traditional understanding of family as a heterosexual unit with one or more children where both parents are the genetic, biological, legal, and social parents of these children. As a whole, the book looks at how adoption and assisted reproduction are morally distinct from one another, but also emphasizes how the two are morally similar. Choosing one, the other, or both of these approaches to family-making can be complex in some respects, but ought to be simple in others, provided that one's main goal is to become a parent.
