This 2019 Article IV Consultation focuses on Curaçao and Sint Maarten’s near and medium-term challenges and policy priorities and was prepared before coronavirus disease 2019 became a global pandemic and resulted in unprecedented strains in global trade, commodity and financial markets. The fiscal position in Curaçao improved in the past two years, in part due to implemented fiscal measures. Both Curaçao and Sint Maarten would benefit from introducing a Fiscal Responsibility Framework. It could incorporate a central government debt ratio as a long-term anchor and operational rules calibrated to meet it. The report suggests that risks in the financial sector need to be addressed as a matter of priority. The authorities should develop a strategy for addressing financial sector vulnerabilities with the objective of preserving financial stability while minimizing fiscal costs. Significant strengthening of supervision and a complete overhaul of the bank resolution framework are also urgently needed. An across-the board improvement in the governance framework should be a key priority in both countries. Vulnerabilities in the financial system point to the need to strengthen governance in the financial sector.

On October 10, 2010, the Netherlands Antilles, an autonomous country within the Kingdom of the Netherlands consisting of five islands in the Caribbean, was dissolved. Two of the islands, Curacao and Sint Maarten, became autonomous countries within the Kingdom. The other three islands (Bonaire, Saba, and Sint Eustatius), were integrated into the Netherlands as special "public bodies." The status of Aruba, the other Caribbean country within the Kingdom, remained the same. This study examines the process that lead to the dissolution of the Netherlands Antilles, and the current status of the islands, from the viewpoint of the right to self-determination of peoples under international law. In particular, the book examines how the individual islands of the former Netherlands Antilles became separate units of self-determination and how the choices that lead to their current status were made. Especially, the integration of the islands of Bonaire, Saba, and Sint Eustatius into the Netherlands raises complicated questions about the conformity with international law of their current status and the continued relevance of the right to self-determination.

The Kingdom of the Netherlands, which includes the Netherlands, Aruba, Curacao, and Sint Maarten, is a constitutional monarchy. The government of the Netherlands (the term used to designate, inclusively, the European part of the state and the Caribbean islands of Bonaire, Saba, and Sint Eustatius) has a bicameral parliament; the country's 12 provincial councils elect a first chamber and the second chamber is elected by popular vote. A prime minister and a cabinet representing the governing political parties exercise executive authority. Aruba, Curacao, and Sint Maarten have unicameral parliamentary systems and are autonomous countries within the kingdom, except in foreign policy, defense, and other “kingdom issues.” General elections held in the Netherlands in September 2012 were generally free and fair, as were those in Aruba on September 27, 2013. Ultimate responsibility for safeguarding fundamental human rights and freedoms in all the territories of the kingdom lies with the combined kingdom government. Civilian authorities maintained effective control over the security forces. They investigated the infrequent reports that security forces committed human rights abuses and applied appropriate disciplinary or punitive measures. With no widespread or systemic abuses, the most salient human rights problem in the Netherlands was societal animosity toward certain ethnic and religious groups, particularly Muslim immigrants from North Africa, Turkey, and the Middle East. Authorities prosecuted individuals during the year for violations of a law prohibiting public speech that incites hatred or discrimination, but convictions were rare. There were reports of violence against women and children, anti-Semitic incidents, societal discrimination and violence against some religious and ethnic minorities, and trafficking in persons for sexual exploitation and forced labor. Prison conditions in Aruba, Curacao, and Sint Maarten remained substandard in several areas, although new improvement projects were underway. In these portions of the kingdom, governments generally took steps to prosecute officials, but reputable observers contended that political factors prevented investigation or prosecution in some cases.

Caribbean archaeological heritage is threatened by natural impacts but also increasingly by economic developments, often resulting from the tourist industry. The continuous construction of specific projects for tourists, accompanied by illegal practices such as looting and sand mining, have major impacts on the region's archaeological heritage. The geopolitical and cultural diversity of the Caribbean, the general lack of awareness of island histories and multiple stakeholders involved in the preservation process, have in many cases slowed down the effective enforcement of regulations and heritage legislation. The development of archaeological heritage management (AHM) in the Dutch Caribbean islands started slowly in the early years of their semi-autonomy within the Kingdom of the Netherlands from 1954 onwards. With the dissolution of the Netherlands Antilles on 10 October 2010, Curaçao and St. Martin obtained a more autonomous status within the Kingdom, similar to Aruba has since 1986.
