Why then has legalism been neglected in the study of German politics? Drawing on constitutional and legal history, this book reconsiders the creation of the German state and the nature of the 'bourgeois revolution'. The author reviews the critical time period of 1814-1930 to demonstrate the links between the legal code and political evolution. She argues that German liberals perceived that the ends of revolution could be achieved legislatively; thus Germany was able to attain a modern political and social system while avoiding - or at least delaying - violent movements. Diese Studie ist eine erste Gesamtpublikation von Ergebnissen eines theore tisch-empirischen Forschungsprojekts zu "Klasse und Geschlecht", das von Petra Frerichs und Margareta Steinrücke in der Zeit von 1991 bis 1996 durch gefiihrt wurde. Margareta Steinrücke war bis Oktober 1993 wissenschaftliche Angestellte des Instituts, seit November 1993 arbeitet sie als Referentin fiir Frauenforschung an der Angestelltenkammer in Bremen. Das gemeinsam am ISO begonnene Projekt konnte dank der Unterstützung unseres Instituts direktors Prof. Daheim weitergefiihrt und trotz der räumlichen Distanz auch erfolgreich abgeschlossen werden. Die von M. Steinrücke bearbeiteten Teile und Themen (Sozialisation, Habitus und Lebensstile) werden in einer eigenen Buchveröffentlichung zu einem späteren Zeitpunkt publiziert. Einige arbeits teilig von ihr erstellten Kapitel, auf die hier aus systematischen Gründen nicht verzichtet werden kann, werden aber bereits in dieser Studie veröffentlicht; sie sind besonders gekennzeichnet. Am Zustandekommen und am erfolgreichen Abschluß dieses Projekts sind viele beteiligt. So haben wir zeitweilig in personeller Verstärkung arbeiten können: Als wissenschaftliche Hilfskraft hat zunächst Irmgard Hermann Stojanov, später Felizitas Pokora mitgearbeitet. Wir danken beiden fiir ihre Unterstützung. Die Durchführung des quantitativen Teils der Untersuchung wäre ohne die Hilfe von Susann Kluge vom DFG-Sonderforschungsbereich 186 (Bremen) und Ralf Himmelreicher (Bremen) so nicht möglich gewesen, die mit großer Geduld und Sachkenntnis die Daten des Sozioökonomischen Panels gemäß den Fragestellungen des Projekts berechnet haben.

Behandelt wird die Rechtsentwicklung im Bereich der politischen Rechte, der verfassungsrechtlichen Gleichheitsgarantie, der Gleichstellung im Arbeits- und Berufsleben und im Eherecht, wie auch der Einfluss des internationalen Rechts (EMRK, CEDAW) und des Rechts der EU. Marriage was historically not only a romantic ideal, but a tool of exploitation of women in many regards. Women were often considered commodities and marriage was far away from the romantic stereotypes people relate to it today. While marriages served as diplomatic tools or means of political legitimization in the past, the discourses about marital relationships changed and women expressed their demands more openly. Discourses about marriage in history and literature naturally became more and more heated, especially during the "long" 19th century, when marriages were contested by social reformers or political radicals, male and female alike. The present volume provides a discussion of the role of marriage and the discourses about in different chronological and geographical contexts and shows which arguments played an important role for the demand for more equality in martial relationships. It focuses on marriage discourses, may they have been legal or rather socio-political ones. In addition, the disputes about marriage in literary works of the 19th and 20th centuries are presented to complement the historical debates.

This book raises awareness about gender perspective in political and legal theories and historical analysis. The impacts of feminist political and legal theories, as well as critical legal studies, have been embedded in all the papers in different ways and degrees. Differences among feminist political and legal ideas are visible in the different approaches. The ongoing issue of defining gender, for example, is a recurring theme in the texts. Some papers question the binary basis of the gender issue and the notion of gender as such, while others start from the binary dichotomy and attempt to expand the consideration towards a multi-dimensional understanding of gender identities. The main focus is on a feminist reconsideration of all relevant fields of legal knowledge. The primary aim is to demystify the seemingly neutral character of legal norms and legal knowledge and highlight the power relations at different layers, beginning with male and female legal subjects of Western heredity (in terms of culture, ethnicity, and race), then moving on to different needs and power relations among female persons of different races and classes, and finally addressing differentiating gender relations and identities beyond the framework of the women-men binary codification, i.e., also taking into consideration the multiple options of intersex, transgender, queering, etc. Taking seriously the issue of the “maleness” of political and legal theories is indeed a challenging and relevant endeavor for legal scholars. The male bias is present not only throughout history but also in the present, given that our “universal” categories of political and legal thought are still overburdened by unequal power relations. It is also important to open our minds and knowledge production for a gender-sensitive and gender-competent intersectional approach, which would also include various queer-, race- and class-based considerations. These tasks should be of interest not only to critical legal scholars but also all those belonging to mainstream legal and political thought.
