The central goal of this volume is to bring the learning perspective into the discussion of intuition in judgment and decision making. The book gathers recent work on intuitive decision making that goes beyond the current dominant heuristic processing perspective. However, that does not mean that the book will strictly oppose this perspective. The unique perspective of this book will help to tie together these different conceptualizations of intuition and develop an integrative approach to the psychological understanding of intuition in judgment and decision making. Political theory draws on a number of different disciplines, such as political science, philosophy, history and law. It is a broad subfield; its practitioners, depending on their background, bring different perspectives and approaches to the study of political thought, which range from historical to normative. Moreover, political theory often draws on the insights of, as well as engages in a dialogue with, social theory, ethics and the philosophy of law. In addition, nowadays, political theory has expanded to include the study of ‘the international’ (international political theory). For all these reasons, political theory is a core subject taught in a variety of academic departments. Yet, paradoxically, there has been an increasing tendency in the past few years for political theory to be marginalized in the academy. This is because so much academic policy concentrates on the main branches of the disciplines within which political theory falls. Even worse for political theory, social theory and the philosophy of law, or legal philosophy, with which it enters into fruitful dialogue, are themselves ‘weak’ areas within sociology and law, respectively. The aim of this volume is to address this situation. What are the problems and challenges that political theory faces today? What is its importance as a distinctive branch of enquiry? What are its main concerns? The fact that political thought operates across disciplinary boundaries and often challenges the boundaries of the aforesaid disciplines is one of its greatest strengths.

This book examines different legal systems and analyses how the judge in each of them performs a meaningful review of the proportional use of discretionary powers by public bodies. Although the proportionality test is not equally deep-rooted in the literature and case-law of France, Germany, the Netherlands and the United Kingdom, this principle has assumed an increasing importance partly due to the influence of the European Court of Justice and European Court of Human Rights. In the United States, different standards of judicial review are applied to review ‘arbitrary and capricious’ agency discretion. However, do US judges achieve a similar result to the proportionality or reasonableness test? Drawing together a selection of key experts in the field, this book analyses the principle of proportionality in the judicial review of administrative decisions from different perspectives. The principle is first examined in the context of recent developments in the literature and case-law, including the inevitable EU influence, then light shall be shed on the meaning of this principle in the specific case-law of the European Court of Justice and European Court of Human Rights. Finally, the authors go on to explore the ways in which US judges consciously ‘sanction’ the ‘disproportionate’ and/or unreasonable’ use of agency discretion. In the legal systems where the proportionality test plays a very limited role, Ranchordás and de Waard also try to clarify why this is the case and look at what alternative solutions have been found. This book will be of great interest to scholars of public and administrative law, and EU law.

This volume contains papers presented in a workshop of international experts in September 2008 in Berlin. The experts discussed how environmental consequences of EU legislation can be incorporated in a more effective way. In other words, this contribution focuses on the question of which measures can strengthen the cons- eration of environmental effects in the EU impact assessment procedure and in the subsequent legislative decision-making process. This allows drawing conclusions for the impact assessment process in Germany. This volume begins with an introductory paper (Bizer/Lechner/Führ) which served as the basis for discussion in our workshop. The questions raised in this paper are addressed by the authors of the subsequent chapters. Stephen White (DG Environment, EU-Commission) discusses the impact assessment from an int- nal perspective within the Commission. Pendo Maro (European Environmental Bureau) reviews the impact assessment practice from the perspective of an en- ronmental NGO. Martin Schmidt et al. discuss the potential for more formalism to strengthen environmental issues within impact assessments and favour a checklist.
