Haben sich die Deutschen in der Kolonialzeit in Südwestafrika vor hundert Jahren eines Völkermordes schuldig gemacht? Im Mittelpunkt des Buches steht die brisante aktuelle Diskussion um die Forderung der Herero nach Entschädigung. Am 12. Januar 1904 erhoben sich die Herero gegen die deutsche Kolonialmacht im heutigen Namibia. Hundert Jahre später klagen die Herero gegen die deutsche Bundesregierung und einige deutsche Unternehmen auf Wiedergutmachung. Dabei beziehen sich die Nachkommen der Opfer auf die Entschädigung ehemaliger jüdischer Zwangsarbeiter. Die Diskussion um den Völkermord und die Klage macht deutlich, dass in Deutschland und Namibia die Zeit des Kolonialismus längst noch nicht aufgearbeitet ist. In beiden Ländern steht dieser Prozess erst am Anfang. Das vorliegende Buch kann dazu beitragen, eine öffentliche Debatte um Kolonialschuld und Entschädigung zu führen.

Facharbeit (Schule) aus dem Jahr 2019 im Fachbereich Politik - Thema: Geschichte der Internationalen Beziehungen, Note: 13, , Veranstaltung: Geschichte, Sprache: Deutsch, Abstract: Um die Leitfrage, ob ehemalige Kolonialmächte dazu verpflichtet sind, ehemaligen Kolonien Entschädigungen zu zahlen, im Falle der ehemaligen Kolonie Deutsch‐Südwestafrikas, dem heutigen Namibia, beantworten zu können, muss man zunächst die Geschichte unserer Kolonialherrschaft betrachten. Dazu soll dieser Aufsatz zunächst den Beginn der Kolonie erläutern, wobei besonders die Gründe der Koloniebildung und die Verwaltung der Kolonie wichtig sind, um die später aufkommenden Konflikte verstehen und erklären zu können. Bei den aufkommenden Konflikten werde ich mich in diesem Aufsatz auf die Aufstände der Herero und Nama Völker konzentrieren, da diese die Geschehnisse in Gang setzten, die heute häufig als Völkermord bezeichnet werden. Bei diesen Aufständen werden jeweils die Vorgeschichte bzw. die Gründe für die Konflikte herausgearbeitet und dann die Eskalierung derer betrachtet. Des Weiteren werde ich den Verlauf der beiden Aufstände untersuchen, um somit auch die Auswirkungen dieser erklären zu können. Die Folgen beider Aufstände sind die gleichen: die Erschaffung von Konzentrationslagern, die Zwangsarbeit und der Völkermord an beiden Stämmen, wobei diskutiert werden muss, ob es sich bei den Geschehnissen tatsächlich um einen Völkermord handelte. Genau diese Folgen der Aufstände sind es, die die Herero und Nama zu der Klage um Entschädigung bewegten und daher sind sie wichtig, um die Schuldfrage und die Frage nach Kompensation der Schäden zu beantworten. Um die Klage und die möglichen Ausgänge besser analysieren zu können, werde ich auch andere, vorhergehende Klagen, die sich mit der Leitfrage beschäftigen betrachten und mit der Klage der Herero und Nama vergleichen. Durch die großen und weitreichenden Auswirkungen der Kolonialzeit, sowohl auf Deutschland als auch auf die Kolonien, sind die Geschehnisse bis heute ein wichtiger Teil unserer Geschichte und durch die Klage gewinnen sie nochmals an Aktualität. Daher hielt ich es für angemessen und sogar erforderlich die Geschichte der deutschen Kolonialzeit nochmals zu analysieren und neu zu beurteilen. Aus diesem Grund wählte ich "die Kolonialzeit Deutschlands in Namibia" als Thema dieser Arbeit und hoffe meine Leitfrage "Sind ehemalige Kolonialmächte dazu verpflichtet, ehemaligen Kolonien Entschädigungen zu zahlen?" an dem Beispiel der beiden Länder beantworten zu können.

From 1884 to 1914, the world's fourth-largest overseas colonial empire was that of the German Kaiserreich. Yet this fact is little known in Germany and the subject remains virtually absent from most school textbooks. While debates are now common in France and Britain over the impact of empire on former colonies and colonizing societies, German imperialism has only more recently become a topic of wider public interest. In 2015, the German government belatedly and half-heartedly conceded that the extermination policies carried out over 1904-8 in the settler colony of German South West Africa (now Namibia) qualify as genocide. But the recent invigoration of debate on Germany's colonial past has been hindered by continued amnesia, denialism and a populist right endorsing colonial revisionism. A recent campaign against postcolonial studies sought to denounce and ostracize any serious engagement with the crimes of the imperial age. More and more, the descendants of indigenous victims of genocide, land expropriation, forced labor, and other systematic human rights violations committed by colonial powers are seeking reparations under international law from the modern successor governments and corporations. As the number of colonial reparations cases increases, courts around the world are being asked to apply international law to determine whether reparations are due for atrocities and crimes that might have been committed long ago but whose lasting effects are alleged to injure the modern descendants of the victims. Sarkin analyzes the thorny issues of international law raised in such suits by focusing on groundbreaking cases in which he is involved as legal advisor to the paramount chief of the Herero people of Namibia. In 2001, the Herero became the first ethnic group to seek reparations under the legal definition of genocide by bringing multi-billion-dollar suits against Germany and German companies in a number of U.S. federal courts under the Alien Torts Claim Act of 1789. The Herero genocide, conducted in German South-West Africa (present-day Namibia) between 1904 and 1908, is recognized by the UN as the first organized state genocide in world history. Although the Herero were subjected to Germany's First Genocide, they have, unlike the victims of the Holocaust, received no reparations from Germany. By machine-gun massacres, starvation, poisoning, and forced labor in Germany's first concentration camps, the German Schutztruppe systematically exterminated as many as 105,000 Herero women, and children, composing most of the Herero population. Sarkin considers whether these historical events constitute legally defined genocide, crimes against humanity, and other international crimes. He evaluates the legal status of indigenous polities in Africa at the time and he explores the enduring impact in Namibia of the Germany's colonial campaign of genocide. He extrapolates the Herero case to global issues of reparations, apologies, and historical human rights violations, especially in Africa.

This study recounts the reasons why the order for the Herero genocide was very likely issued by the Kaiser himself, and why proof of this has not emerged before now. In 1904, the indigenous Herero people of German South West Africa (now Namibia) rebelled against their German occupiers. In the following four years, the German army retaliated, killing between 60,000 and 100,000 Herero people, one of the worst atrocities ever. The history of the Herero genocide remains a key issue for many around the world partly because the German policy not to pay reparations for the Namibian genocide contrasts with its long-standing Holocaust reparations policy. The Herero case bears not only on transitional justice issues throughout Africa, but also on legal issues elsewhere in the world where reparations for colonial injustices have been called for. This book explores the events within the context of German South West Africa (GSWA) as the only German colony where settlement was actually attempted. The study contends that the genocide was not the work of one rogue general or the practices of the military, but that it was inexorably propelled by Germany's national goals at the time. The book argues that the Herero genocide was linked to Germany's late entry into the colonial race, which led it frenetically and ruthlessly to acquire multiple colonies all over the world within a very short period, using any means available. Jeremy Sarkin is Chairperson-Rapporteur of the United Nations Working Group on Enforced or Involuntary Disappearances, and is at present Distinguished Visiting Professor of Law at Hofstra University in Hempstead, New York. He is also an Attorney of the High Court of South Africa and of the State of New York. At the end of the First World War, Germany appeared to have lost everything: the lives of millions of soldiers and civilians, control over borderland territories, and, above all, a sense of national self-worth in the international political arena. But it also lost almost three million square kilometres of land overseas in the form of colonies and concessions in Africa, China, and the Pacific. Allied powers declared Germany unfit to rule over overseas populations, and it was forcibly decolonized. It thus became the first 'postcolonial' European nation that had participated in the 'new imperialism' of the modern era. The end of colonialism was the beginning of a memory culture that has been remarkably long-lived and dynamic. Postcolonial Germany traces the evolution of the collective memory of German colonialism, stretching from the loss of the colonies across the eras of National Socialism, national division, and the Cold War to the present day. It shows to what extent this memory was intimately bound to objects of material culture in the former colonial metropole, such as tropical fruit sold at colonial balls, state gifts handed to the former colonies at independence, and ethnological items kept as family heirlooms. The study draws on a wide range of sources, including popular literature, oral history, and previously unexplored archival holdings. It marks an important shift in historical methodology, considering the significance of both material culture and private memories in constructing accounts of the past. Above all, it raises important questions about the public responsibilities of postcolonial nations and governments in Europe and their relationship to the private legacies of colonialism.
