Eksekusi atas hukuman dwangsom dilakukan dengan cara verhaal executie, yang tidak lain sebagaimana eksekusi pembayaran sejumlah uang, yakni dengan cara terlebih dahulu meletakkan sita eksekusi (eksecutorial beslag) atas barang-barang milik tergugat, untuk kemudian dijual dengan cara lelang melalui Kantor Lelang Negara. Selanjutnya hasil dari Penjualan Lelang atas barang-barang milik tergugat tersebut lalu dibayarkan kepada penggugat melalui Pengadilan Agama sesuai dengan jumlah hukuman dwangsom yang dibebankan kepada tergugat dan ditambah dengan biaya pelaksanaan eksekusi tersebut. Hukum acara Peradilan Pajak merupakan bentuk jaminan hak bagi WP dan Fiskus untuk menyelesaikan sengketa pajak yang dihadapinya, di samping menjadi rujukan bagi Hakim Pengadilan Pajak (PP) selaku judex factie selama dalam proses mengadili sengketa yang mencakup bagaimana; (i) memeriksa perkara berdasarkan fakta atau peristiwa yang melatarbelakangi terjadinya sengketa beserta alat-alat bukti yang diungkap di persidangan, mendistribusikan beban dan melakukan penilaian terhadap hasil pembuktian (uji bukti yuridis & administratif via matriks sengketa) dari para pihak; (ii) memutus perkara dengan meng-konstatir dalil-dalil hukum ke dalam peristiwanya yang konkret, menerapkan (mengkonstituir) hukumnya berdasarkan alasan dan pertimbangan hukum yang relevan disertai alat bukti yang cukup serta berdasarkan keyakinan hakim; dan (iii) memenuhi syarat sah dan wajibnya sebagai putusan yang berkuatan hukum tetap (inkracht van gewjisde), yakni mempunyai kekuatan hukum mengikat (binderide kracht), kekuatan pembuktian (bewijszende kracht) dan bersifat eksekutorial (eksecutoriale kracht), sehingga dapat dilaksanakan oleh para pihak. Secara prinsip maupun teknis, terdapat serangkaian syarat formil dan materiil yang harus dipenuhi dalam beracara (menyelesaikan sengketa) di PP, yang dalam hal ini menjadi panduan teknis litigasi bagi para pihak (WP dan Fiskus) bagaimana cara mengajukan dan merancang berkas sengketa Banding dan Gugatan, Surat Uraian Banding (SUB) dan Bantahan, Surat Tanggapan, matriks sengketa, dan Menyusun Kesimpulannya (conclusion) dengan baik. Dengan memadukan asas hukum acara yang berlaku di PTUN yang merupakan induk hukum administrasi secara umum (ordinative law) dan menerapkan asas lex spesialis yang berlaku di PP sebagai turunan hukum administrasi secara khusus di bidang perpajakan (sub-ordinative law), akan menambah kompilasi keahlian kita menjadi integratif yang mencakup bagaimana sebenarnya “mode” teknis litigasi yang yang akomodasi dalam hukum acara Peradilan Pajak. Di samping itu, mengingat PP sebagai Pengadilan Khusus di lingkungan PTUN, maka dalam buku ini diberikan pula studi komparatif bagaimana mekanisme yudisial yang berlaku PTUN dan di semua Lingkungan Peradilan di bawah Mahkmah Agung (MA), termasuk dalam penerapan asas-asas hukum acaranya yang relevan, agar diperoleh gambaran bagaimana seharusnya putusan Hakim PP itu dapat memberikan kepastian hukum dan mencerminkan rasa keadilan secara lebih substantif di bidang perpajakan, bukan demi politik anggaran pendapatan negara semata. Law and the Utopian Imagination seeks to explore and resuscitate the notion of utopianism within current legal discourse. The idea of utopia has fascinated the imaginations of important thinkers for ages. And yet—who writes seriously on the idea of utopia today? The mid-century critique appears to have carried the day, and a belief in the very possibility of utopian achievements appears to have flagged in the face of a world marked by political instability, social upheaval, and dreary market realities.
