This book addresses issues concerning the shifting contemporary meaning of legal certainty. The book focuses on exploring the emerging tensions that exist between the demand for legal certainty and the challenges of regulating complex, late modern societies. The book is divided into two parts: the first part focusing on debates around legal certainty at the national level, with a primary emphasis on criminal law; and the second part focusing on debates at the transnational level, with a primary emphasis on the regulation of transnational commercial transactions. In the context of legal modernity, the principle of legal certainty—the idea that the law must be sufficiently clear to provide those subject to legal norms with the means to regulate their own conduct and to protect against the arbitrary use of public power—has operated as a foundational rule of law value. Even though it has not always been fully realized, legal certainty has functioned as a core value and aspiration that has structured normative debates throughout political modernity, both at a national and international level. In recent decades, however, legal certainty has come under increasing pressure from a number of competing demands that are made of contemporary law, in particular the demand that the law be more flexible and responsive to a social environment characterized by rapid social and technological change. The expectation that the law operates in new transnational contexts and regulates every widening sphere of social life has created a new degree of uncertainty, and this change raises difficult questions regarding both the possibility and desirability of legal certainty. This book compiles, in one edited volume, research from a range of substantive areas of civil and criminal law that shares a common interest in understanding the multi-layered challenges of defining legal certainty in a late modern society. The book will be of interest both to lawyers interested in understanding the transformation of core rule of law values in the context of contemporary social change and to political scientists and social theorists.

The book tries to identify the main contours of unjusticiability and non-justiciability from an historical and comparative perspective distinguishing between common law world and civil law tradition. In the light of a general overview, the aim of this publication is to reflect on the utility of paving the way for a much wider approach to unjusticiability. More precisely, some scholars have recently suggested that such a notion could embrace all the situations where a court does not decide a case, so that it is impossible for the plaintiff to have the case decided by a court. A first category covers the situations where the court refuses to judge because it does not want to judge. A second category is related to all the cases where there is an impossibility to reach a decision. Any case where the judge cannot or does not wish to make justice--si iudex non facit iustitiam--continues to indicate a series of new (and old) questions.

September 2001 ist das herkömmlich-rechtliche Koordinationssystem in der Balance von Freiheit und Sicherheit durcheinander gebracht. Die rechtspolitische Debatte kann nicht so tun, als sei alles noch wie früher, aber es ist auch schwierig mit dieser neuen Situation umzugehen und es kommt natürlich die Frage auf: Welche rechtsdogmatischen oder rechtspolitischen Angebote stehen zur Verfügung, um diese neue komplexe Welt vor dieser Herausforderung zu schützen? In diesem Zusammenhang, besonders zum internationalen Terrorismus, kam nun immer wieder ein Begriff auf, der seit Jahren auf wissenschaftlicher Ebene bei rechtspolitischen Diskussionen und neuerdings auch in der Praxis, auf politischer Ebene an Bedeutung gewinnt. Das „Feindstrafrecht“. Dabei geht es aber auch um die Frage, ob diese Terroristen dieselben Grundrechte besitzen oder besitzen dürfen wie jeder andere Bürger auch. Von der Entwicklung bis zu unserer heutigen Zeit ist das Feindstrafrecht unüberschaubar geworden. Die Diskussion ist wie unser Oberthema sagt, sowohl global, als auch sehr emotional. Dies zeigt sich vor allem in der Auswahl der Autoren, die sich mit dieser Thematik befassen. Rechtsgelehrte aus Argentinien, Spanien, Italien, Frankreich, England und Deutschland, die mit wichtigen Sammelwerken und Büchern ihre Meinung kundtun. Bücher, die sogar dreitausend Seiten füllen, verdeutlichen die internationale Bedeutung dieses Themas. Zu den wichtigsten gehören vor allen das Werk von Vormbaum „Kritik des Feindstrafrechts“ und von Cancio Meliá/Gomez-Jara Treves die zwei Bände „Derecho Penal del Enemigo“. Diese internationale, aber zum größten Teil sehr kritische Auseinandersetzung mit diesem Thema hat es für mich sehr interessant gemacht mit diesem Thema zu arbeiten. Vor allem stellten sich mir die Fragen, wieso die Diskussionen derart kritisch sind und zum Zweiten wie wurde das Konzept in anderen Ländern aufgenommen?
