Studienarbeit aus dem Jahr 2017 im Fachbereich Medien / Kommunikation - Journalismus, Publizistik, Note: 1,0, Freie Universität Berlin, Sprache: Deutsch, Abstract: Der Soziologe und Gesellschaftskritiker Niklas Luhmann hat bereits die Fähigkeit der Kritik in seiner Theorie ausgeschlossen. Es gibt keine Kritik, da es keine übergeordnete Position gibt, die sich die Beobachtung der Gesellschaft zur Aufgabe gemacht hat, aus der heraus zu kritisierende Zustände identifiziert werden können. Für die Systemtheorie nach Luhmann allein kann diese Behauptung durchaus zutreffen. Doch spätestens mit dem 2013 erschienen Buch „Kritische Systemtheorie – Zur Evolution einer normativen Theorie“ scheint sich etwas zu ändern. Mit dem Aufkommen einer Synthese der Kritischen Theorie nach Adorno und Horkheimer (1944), sowie der Luhmannschen Systemtheorie ergibt sich die Kritische Systemtheorie, die sich der Möglichkeiten gewidmet hat, aus Beobachtungen der Gesellschaft heraus Kritik zu üben. Aus den theoretischen und nicht-empirischen Behauptungen der Kritischen Theorie und den empirischen Belegen der Systemtheorie soll eine Einheitstheorie formuliert werden. Im Folgenden werde ich versuchen, die Vorgehensweise dieser neuen Theorie anhand des von Amstutz gewählten Beispiels der kritischen Systemtheorie des Rechts zu beschreiben. Weiterführend wird mit der Struktur der von ihm entwickelten Thesen versucht, das zuvor beschriebene neue Theoriemodel auf den Journalismus anzuwenden und eine Art kritische Systemtheorie des Journalismus zu beschreiben, um der Frage nachzugehen: Welche Perspektive hat der Journalismus in einer Kritischen Systemtheorie und wo liegt seine Möglichkeit, Kritik zu üben? Um diese Frage beantworten zu können, beziehe ich mich auf die Texte von Wagner (2013) und Amstutz (2013) aus dem bereits erwähnten Buch und auf einen Text von Blöbaum (2016), der den Journalismus als das Funktionssystem beschreibt, das er ist.

This book discusses the designs and applications of the social systems theory (built by Niklas Luhmann, 1927–1998) in relation to empirical socio-legal studies. This is a sociological and legal theory known for its highly complex and abstract conceptual apparatus. But how to change its scale in order to study more localised phenomena, and to deal with empirical data, such as case law, statutes, constitutions and regulation? This is the concern of a wide variety of scholars from many regions engaged in this volume. It focuses on methodological discussions and empirical examples concerning the innovations and potentials that functional and systemic approaches can bring to the study of legal phenomena (institutions building, argumentation and dispute-settlement), in the interface with economy and regulation, and with politics and public policies. It also discusses connections and contrasts with other jurisprudential approaches – for instance, with critical theory, law and economics, and traditional empirical research in law. Two decades after Luhmann’s death, the 21st century has brought countless transformations in technologies and institutions. These changes, resulting in a hyper-connected, ultra-interactive world society bring operational and reflective challenges to the functional systems of law, politics and economy, to social movements and protests, and to major organisational systems, such as courts and enterprises, parliaments and public administration. Pursuing an empirical approach, this book details the variable forms by which systems construct their own structures and semantics and ‘irritate’ each other. Dass Edmund Husserl am Problem der Intersubjektivität gescheitert ist, gilt als ausgemacht - und ebenso, welche Konsequenzen daraus zu ziehen sind. Entgegen dem allenthalben pauschal erklärten `Abschied vom Subjekt' spricht aber vieles dafür, dass es in der gegenwärtigen Sozialtheorie eher um eine Reformulierung transzendentaler Subjektivität geht. Diese Interpretationsthese wirft ein neues Licht auf den sozialtheoretischen Diskurs, der im deutschen Sprachraum in den vergangenen dreissig Jahren vom Gegensatz von Jürgen Habermas' und Niklas Luhmanns Theorien bestimmt war: `Diskurs' und `System' erscheinen als gegensätzliche Versuche, `Subjektivität' und `Interität' in ein theoretisch befriedigendes Verhältnis zu setzen. Wenn aber - so die kritische These dieses Buches - weder die Reformulierung von Subjektivität als `Interität' noch die Reformulierung von Subjektivität ohne `Interität' das Problem der Intersubjektivität überzeugend löst, ist dies ein Grund, neuerlich in eine direkte Auseinandersetzung mit Husserls Theorie transzendentaler Subjektivität einzutreten. Dabei stellt sich heraus, dass Husserls vielkritisierter und -skandalisierter Versuch, den Sinn `Anderer' im `Eigenen' zu fundieren, in der transzendentalphänomenologischen Subjekttheorie durch ein umgekehrtes Begründungsverhältnis konterkariert wird. Bei aller Problematik dieser Theorieanlage - welche nur in Gegenwendung zu den Gewohnheiten der Husserl-Interpretation, vor allem aber auch zu Husserls Selbstinterpretation in den Blick kommt - zeigt sich, dass der phänomenologische Begriff des transzendentalen Subjekts seinen Reformulierungen als Diskurs und als System in mancher Hinsicht überlegen ist.

This volume addresses the pluralistic identity of the legal order. It argues that the mutual reflexivity of the different ways society perceives law and law perceives society eclipses the unique formal identity of written law. It advances a distinctive approach to the plural ways in which legal cultures work in a modern society, through the metaphor of the mirror. As a mirror of society, it distinguishes between the structure and function of legal culture within the legal system, and the external representation of law in society. This duality is further problematized in relation to the increasing transnationalisation of law.
