Nearly all oil and Gas in the world is developed through some form of contracts and for more than a century the petroleum contracts, as a basic legal tool, have played a crucial role between the contractual parties in the petroleum sector. The development of these sorts of contracts demonstrates the dynamic changes that have occurred in the petroleum industry. Relevant to the question of balancing the interests between the host state (HS) and the international oil company (IOC), this study examines the contractual measures that have been followed by the parties to create fair and adequate relationship, and also keep the contractual interests in a mutual and balanced manner. Furthermore, this study discusses the structure of the petroleum contracts with a special reference to the main terms of the KRG's Production Sharing Contracts. As a subsidiary concentration, the researcher also draws attention to the Kurdistan Region oil and gas law, the Iraqi constitutional approach of the region and the governorate's authority in striking oil and gas development contracts. This research applies a descriptive method to attain its objectives in its main discussions about the main features of the production sharing contracts in the Kurdistan Region of Iraq, the balance of interests between the host state and investor (IOC) under KRG's PSCs and the contractual mechanisms to guarantee the balance of interests between the host state and the investors in the KRG's PSC. Also this study shall seek the examination of the contractual relational outcome under the petroleum production contracts and their mechanisms. It will also take an analytical and critical assessment to evaluate the difficulties encountered in achieving fair interests for both parties. The current study's findings show that, the PSC is a suitable instrument for the Kurdistan Region of Iraq to build up its domestic industry with the assistance of foreign oil companies. This research has also proven that these mechanisms are the main devices to encourage the parties to protect their interests and keep the balance of their relations during the life time of the contract. By adopting a range of mechanisms which are fair and flexible to both parties (HS & IOC) and adapted to any unpredictable changes that may take place with time, the KRG creates a reasonable environment for the International Oil Companies (IOC) to invest in its petroleum sector and keeps the parties' interest in a balanced manner. Hence, this study has shown that by introducing a flexible PSC and reasonable mechanisms, the Kurdistan Region of Iraq has its own strategy for developing its petroleum sector and has established itself as an attractive region for foreign investment.

"Much of Iraq's considerable oil and gas reserves are thought to lie in the areas of northern Iraq claimed by the Kurds. Some of this area is under the control of Kurdish Regional Government (KRG) but much of the oil and gas is in disputed territories. The question of authority over these oil and gas reserves is important not only to the international energy companies with negotiated agreements with the KRG for the exploitation of these resources, but also because the issue is a major factor in the relations between the central government in Baghdad and the KRG regional authorities undermining the prospect for a unified Iraq. This book examines the historical and contextual background to the oil and gas in the Kurdish territories placing particular emphasis on the reserves situated in the provinces disputed with the central government. The book examines the legal basis of the current dispute looking at the relevant legislation including the Iraqi federal constitution, the KRG's own constitution and extant contracts with international oil companies. It also considers the developing international law on traditional peoples and their claims to natural resources. The book connects the legal questions which form the basis of this dispute and considers the larger issues of access to natural resources, as well as the place of regional minorities in federal systems. The book offers a critical assessment of the existing law as well as current efforts to address the Kurdish oil and gas controversy, especially from the perspective of federal systems"--Provided by publisher.

This book presents a ‘critical reappraisal’ of the resource curse thesis and extends the analysis to consider political and social dimensions, and thus, the importance of structure in the petroleum sector’s governance model. It examines major challenges surrounding the governance of petroleum resources, and the implications for the economic growth and development of hydrocarbon-abundant countries as a result of ineffective economic, political, and social mechanisms. The book subsequently investigates a range of causal factors that may promote or hinder the effective management of oil and gas resources in the Kurdistan Region, which also has implications for the security of the wider region and for global energy security. The book also seeks to arrive at lessons learned and policy guidelines to help inform other new petroleum-exporting countries and regions about how to best manage their newfound wealth.

Development in Iraq¿s oil and natural gas sector is proceeding, in spite of continuing delays in agreeing to hydrocarbon sector and revenue sharing legislation to define new terms for the mgmt. of the country¿s significant oil and natural gas resources. Both the Bush Admin. and the 110th Congress considered the passage of oil and gas sector framework and revenue sharing legislation as important benchmarks that would indicate the Iraqi government¿s commitment to promoting political reconciliation and providing a solid foundation for long term economic development in Iraq. This report reviews policy proposals and interim contracts, analyzes the positions of various Iraqi political actors, and discusses potential implications for U.S. foreign policy goals in Iraq. Examining the interplay between the oil economy and identity politics using the Kurdistan Region of Iraq as a case study, this book tells the untold story of how extractivism in the Kurdish autonomous region is interwoven in a mosaic of territorial disputes, simmering ethnic tensions, dynastic rule, party allegiances, crony patronage, and divergent visions about nature. Since the ousting of Saddam Hussein, the de-facto borders of the Kurdistan Region of Iraq have repeatedly changed, with energy interests playing a major role in such processes of territorialisation. However, relatively little research exists on the topic. This book provides a timely, empirical analysis of the intersections between extractive industries, oil imaginaries, and identity formation in one of the most coveted energy frontiers worldwide. It shines a light on relations between the global production networks of petro-capitalism and extractive localities. Besides the strained federal relationship with the Iraqi central government, the transformative effects the petroleum industry has had on Kurdish society are also explored in depth. Moreover, the book fills a gap in the literature on Kurdish Studies, which has devoted scant attention to energy-related issues in the re-imagination of Kurdish self-determination. This book will be of great interest to students and scholars of the extractive industries, energy studies, conflict studies, Middle Eastern politics, and political ecology.
