This book investigates the economic organization of ancient societies from a comparative perspective. By pursuing an interdisciplinary approach, including contributions by archaeologists, historians of antiquity, economic historians as well as historians of economic thought, it studies various aspects of ancient economies, such as the material living conditions including production technologies, etc.; economic institutions such as markets and coinage; as well as the economic thinking of the time. In the process, it also explores the comparability of economic thought, economic institutions and economic systems in ancient history. Focusing on the Ancient Near East as well as the Mediterranean, including Greece and Rome, this comparative perspective makes it possible to identify historical permanencies, but also diverse forms of social and political organization and cultural systems. In questo studio, l’autrice analizza il funzionamento del giudizio di scioglimento della comunione non ereditaria nell’ambito del processo privato romano di età classica, dunque con riferimento al tipo di procedura cd. formulare, allo scopo di chiarire l’efficacia della pronuncia di divisione. Nell’ambito del titolo dei Digesta 10.3, dedicato al iudicium communi dividundo, la fattispecie divisoria è considerata dalla prospettiva della funzione svolta dall’adiudicatio, ora come parte formulare, ora come pronuncia dell’organo giudicante. Più in dettaglio, la funzione dell’aggiudicazione nell’ambito della divisione giudiziale è approfondita alla luce della tradizionale lettura in termini meramente costitutivi. Nella riflessione della giurisprudenza romana, l’adiudicatio ricopre, a ben vedere, una funzione eclettica e regolativa degli interessi patrimoniali dei soggetti coinvolti nel giudizio. Precisamente, il contenuto della pronuncia divisoria è individuato avuto riguardo alle caratteristiche della res, per un verso, e alla voluntas dei litiganti, per altro.

En el presente estudio nos proponemos abordar, desde una perspectiva histórico-comparativa, el análisis de las vicisitudes del contrato en los diversos desarrollos de la tradición jurídica romanística, de la que forma parte también el derecho latinoamericano, con la finalidad de analizar las diferentes soluciones que se han propuesto con relación a algunos de sus aspectos sustanciales y determinar así cuáles de ellas se ajustan más y mejor a las problemáticas planteadas por la realidad socio-económica de los países de América Latina (caracterizados por las desigualdades de sus sociedades y las imperfecciones de sus mercados) que puedan servir de guía para la interpretación y aplicación de los ordenamientos vigentes, o bien en miras de una futura reforma o recodificación del derecho de los contratos, a nivel nacional, y/o de su armonización o unificación, a nivel regional. Desde esta óptica, concentraremos nuestra atención en el análisis de tres ejes temáticos principales vinculados a la institución contractual: el de su naturaleza, el de sus alcances y el de sus efectos. Con relación al primero de los temas indicados la disyuntiva consiste en determinar si el elemento caracterizante del contrato debería estar representado exclusivamente por el "consentimiento " o "acuerdo " de las partes (es decir, por el elemento convencional) o si, en cambio, el mismo debería encontrarse en la "reciprocidad " de las prestaciones (o sea, en el elemento causal, identificado con el sinalagma) y, en consecuencia, si la relación contractual tendría que estar regida preponderantemente por el principio de "autonomía de la voluntad " o si, por el contrario debería estar orientada fundamentalmente por las exigencias propias de la "justicia contractual "; tratando de conciliar, en este último supuesto, la "utilidad " (valor natural de los negocios contractuales) con la "justicia " (valor natural del mundo jurídico), para que el contrato sea, además de útil, justo.
