L'appello, nel processo civile italiano del XXI secolo, non è più ciò che tradizionalmente era stato, novum iudicium inteso a porre rimedio non solo agli errori del primo giudice, ma anche alle omissioni e alle insufficienze delle difese, nella consapevolezza che non tutto sulla singola fattispecie riesce chiaro a un semplice e unico sguardo, ma che la ricerca della verità relazionale nel processo, con metodo dialettico e isonomico, è percorso faticoso e aspro, pieno di insidie e da compiersi solo per successive approssimazioni probabilistiche, coltivate attraverso la metodologia del dubbio e secondo appropriati canoni di falsificazione epistemologica. L'appello, sotto il tallone del business globale e i pressanti Diktaten della ragionevole durata del processo, funge ora da mero strumento di controllo del provvedimento impugnato, entro ristretti limiti cognitivi. Di esso però, con un primo grado che non dà garanzie effettive di accuratezza e completezza istruttorie, si potrà fare a meno soltanto in un'aurea aetas, nella quale la chiarezza delle leggi e la certezza delle prove producano la drastica riduzione delle liti. Sino ad allora è bene che l'appello resti "tetragono ai colpi di ventura".ALBERTO TEDOLDI è professore associato di Diritto processuale civile nell'Università di Verona.
