Il presente lavoro è stato ideato con l'intento di affrontare un problema di natura sociale: il malato mentale autore di reato. Un'attenta analisi storica ed evolutiva del presente argomento tenterà di metterà in luce le dinamiche giuridiche e la complessità delle tematiche che si intrecciano nell'applicazione della misura di sicurezza relativa all'internamento del reo non imputabile o semi imputabile, presso l'Ospedale Psichiatrico Giudiziario prima e le Residenze per l'esecuzione delle misure di sicurezza sanitaria (REMS) ora.

Il volume, ponendosi dalla prospettiva del diritto penale, intende offrire degli spunti di riflessione in riferimento all’intricato tema della tutela della salute dei soggetti sottoposti a limitazioni coattive della propria libertà personale. La premessa è quella di una nozione ampia di “luoghi di detenzione”, all’interno della quale ricondurre non solo il carcere, ma anche le residenze per l’esecuzione delle misure di sicurezza (REMS) e i centri di permanenza per i rimpatri (CPR), destinati al trattenimento degli stranieri irregolari. Ciascuna delle tre sezioni in cui si articola il volume fornisce anzitutto una ricostruzione del dato normativo di riferimento, evidenziando quella fuga dalla legalità che troppo spesso caratterizza l’esecuzione delle pene, delle misure di sicurezza personali e del trattenimento degli stranieri irregolari. Si è cercato poi di affrontare questioni specifiche e particolarmente problematiche come il c.d. carcere duro, il diritto di rifiutare le cure del soggetto in vinculis, la responsabilità del medico psichiatra nel nuovo sistema delle REMS. Un’attenzione particolare è stata infine riservata alla giurisprudenza della Corte europea dei diritti dell’uomo, vista la sempre più significativa influenza della stessa per una ridefinizione degli standard minimi di tutela all’interno dei luoghi di detenzione.
