O presente estudo aborda o tema do trust no âmbito do Direito civil português. O trust tem vindo a assumir uma importância decisiva no comércio jurídico internacional e no mundo da alta finança. A sua difusão, para a qual muito contribui a preponderância cultural anglófona, tem despertado o interesse das ordens económicas e jurídicas dos sistemas de base romanística. O trust é o produto da Common Law. Desenvolvido e consolidado ao longo de vários séculos, o instituto fiduciário britânico é um reflexo da sociedade inglesa, da sua cultura e do seu Direito. O sucesso do trust reside na sua maleabilidade. O trust tem sempre demonstrado uma espantosa capacidade de adaptação às necessidades sociais e económicas, em constante mutação. Esta dimensão transversal é, de resto, a característica mais evidente da fidúcia, enquanto instituto atemporal que atravessa todos os sistemas jurídicos. Os negócios fiduciários têm assumido um papel central nos Direitos civis continentais, desde os primórdios do Direito romano. Explorada a dimensão histórica e dogmática do trust e as especificidades do sistema jurídico que o imaginou, passamos a averiguar a possibilidade de receber o instituto na nossa ordem jurídica interna. A demonstração da continuidade da fidúcia no Direito português permite-nos afastar a suposta impossibilidade de constituir, internamente, um negócio atípico que congregue todos os elementos identificativos do instituto fiduciário anglo-saxónico. Podemos, assim, conceber o trust, à luz do Direito português, como um negócio fiduciário stricto sensu para administração e aberto, que pode ser constituído por simples manifestação de vontade, por transmissão da posição jurídica para um terceiro, que assume a posição de fiduciário, ou por disposição testamentária.
