Cet ouvrage est d'abord une réflexion sur le concept d'autorité parentale. Actuellement, celui-ci devrait se trouver affaibli par l'émergence des droits de l'enfant. On oserait dire que parfois, (ex. la liberté sexuelle) la finalité de la fonction parentale c'est l'intérêt de l'enfant tel que ce dernier le définit lui-même et qu'il revendique de défendre en justice sans son représentant légal puisque précisément l'enfant s'oppose à lui...Certes, mais d'autres droits de l'enfant ont revalorisé l'autorité parentale (le droit d'être élevé par ses deux parents ne renforce-t-il pas l'autorité du parent que l'autre voudrait écarter?). Dans le même temps, ce concept devrait se trouver raffermi par la volonté collective de re-responsabiliser les parents trop souvent démissionnaires. Cela se traduit par des projets de légiférer sur une responsabilité civile de plein droit des parents en dehors même de toute faute de l'enfant... Certes, mais cette jurisprudence excessive n'inciterait-elle pas plutôt les parents à mieux s'asurer qu'à mieux surveiller, et le désir de pénaliser les parents est-il bien crédible tant que l'on n'a guère tenté de leur appliquer les ressources du Code pénal (complicité, etc.)? C'est dans un tel contexte de tensions multiples que la réforme de l'autorité parentale s'est effectuée. Ele ne pouvait dès lors n'être qu'un délicat compromis, mais celui qui allait être voté le 4 mars 2002 est-il meilleur? C'est aussi une réflexion sur l'organisation de l'exercice de l'autorité parentale, les innovations législatives françaises rejoignant sur ces points les réformes étrangères. L'innovation la plus évidente concerne la généralisation de la coparentalité. Désormais, c'est le principe aussi dans les familles où les parents sont séparés. L'idée est que le couple parental doit survivre à la disparition du couple "conjugal". Ce n'est qu'un pari du législateur...mais que le juge va devoir honorer! Dans les familles recomposées, la coparentalité est perturbée par le beau-parent: la nouvelle loi lui donnera-t-elle un statut? Dans les familles où les enfants font l'objet d'une mesure d'assistance éducative, la parentalité était le plus souvent occultée: la nouvelle loi incitera-t-elle à changer cette pratique? Une autre inovation d'importance pourrait être le recours plus systématique à la médiation pour résoudre les conflits entre parents. Le médiateur est présenté comme une alternative au juge. Mais si la médiation poursuivait sa "juridicisation", l'alternative présenterait-elle encore un véritable intérêt? C'est enfin une réflexion sur les limites de l'autorité parentale dans les rapports que les parents doivent construire avec leurs enfants. Les sociologues préviennent les juristes: le "bon parent" n'est pas celui qui exercerait de façon exemplaire une autorité parentale "modèle" mais celui qui, en plus, avec un "supplément d'âme" ferait de son enfant "l'objet de sa solicitude" et c'est tout le mérite de Jacques Commaille d'avoir rappelé dans sa conclusion que le droit n'épuisait pas la morale.

Le droit de la famille, dans sa dimension civiliste, fortement ancré dans les cultures nationales des États membres, est une matière qui ne relève pas, en principe, du droit de l’Union européenne. De nombreux aspects de la famille sont sous influence européenne, au point que l’on voit se dessiner les contours d’une « famille européenne ». L’ouvrage propose de mettre en lumière l’acquis européen en matière de droit de la famille, au prisme du droit matériel (citoyenneté européenne, politique sociale de l’Union, fonction publique européenne...), comme du droit international privé. Le droit de la famille de l’Union s’identifie alors comme un «droit spécial» complétant la diversité des droits nationaux de la famille. Sa signification théorique et politique dans l’Union est débattue par les auteurs, autant que son devenir. Loin de demeurer fragmentaire à côté des droits nationaux des États membres, il a probablement vocation à se densifier pour offrir aux citoyens et résidents européens un droit commun de la famille au sein de l’Union. Family law, with its civil law tradition, and strong roots in the national cultures of the Member States, does not normally fall within the scope of European law. However, it is no longer possible to argue that family law is outside European law entirely. There are many aspects of the family which are subject to European influence, to the point that the outlines of a «European family» are starting to emerge. This book is intended to highlight the European experience of family law and its substantive (i.e. European citizenship, EU social policy, EU civil service...) and private international law aspects. Union law therefore contains a form of «special» family law which is shared between the Member States and supplements their national family laws. Its theoretical and political importance in the Union, as well as its future, are discussed by the authors. Far from remaining fragmented alongside the national laws of Member States, it will likely develop to offer European citizens and residents a common family law within the EU.

It is often asserted that ‘A family that prays together, stays together’. But what if a child no longer wishes to pray? This book analyses the law in relation to situations where parents force their children to manifest the parental religion. From thorough examination of international law it argues that, unlike what is generally believed, the human rights regime does not grant parents a right to impose manifestations of their religion on their children. Instead, the author proposes to regard coerced manifestations as a limitation on children’s right to freedom of manifestation, based on national laws that give parents rights at the domestic level under principles such as parental responsibility. The book focuses on two aspects of States’ positive obligations in this regard. First, the obligation to provide a regulatory framework that can protect children’s right to freedom of manifestation, and restricts limitations to those that are proportionate or 'necessary in a democratic society'. Second, to provide access to remedies, which it is argued should consist of access to a family-friendly infrastructure for dispute resolution available to parents and children in conflict over religious manifestation. Both depend heavily on the way States balance power between parents and children at the national level. The book includes three case studies and social research of jurisdictions that offer different perspectives under the principles of parental authority (France), parental responsibility (England) and parental rights (Hong Kong).

The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family.
