Il volume “La declaratoria di immutatio veri nel processo penale” approfondisce il tema dell’accertamento giudiziale del falso, con particolare attenzione alla pronuncia sulla falsità degli atti, imposta dall’ordinamento a protezione dell’interesse pubblico all’affidabilità dei documenti. Ogni qualvolta la mancata rispondenza al vero assurga a thema decidendum di un autonomo giudizio, spetta all’organo giudicante rimuovere, sotto il profilo giuridico, il quid falsi e, qualora sia possibile, ripristinare, sotto il profilo ontologico, il quid veri. La tenuta di questo modello, predisposto dal legislatore per eliminare dalla circolazione l’infedeltà documentale, appare, tuttavia, indebolirsi sul terreno dell’efficacia spiegata dal giudicato venutosi a formare sulla statuizione di falso. Invero, la scelta dell’ordinamento processuale di preservare la completa autonomia del convincimento giudiziale e sottrarre alla res iudicata stabilità decisoria “riflessa” su altri giudizi penali ha finito per conferire alla declaratoria di falso una «efficacia soggettiva variabile», con sostanziale vanificazione dell’impronta marcatamente pubblicistica dello strumento previsto dall’art. 537 c.p.p.
