This volume presents global and comparative perspectives on the perpetual pendular movement of family law between status and contract. It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014.

Si l'on veut ne pas trahir l'amour, rester fidèle au meilleur de lui-même, il faut savoir et accepter que la durée d'une relation est à l'inverse de son intensité. Le mariage, lui, prétend à la durée, privilégiant l'alliance plus que le sentiment. Or, l'alliance, c'est l'inscription sociale de l'infériorité des femmes ou plutôt le renoncement à leur intégrité. À cause de la Grande Peur : peut-être parce qu'ils sortent du ventre des femmes et que, de leurs ventres, ne peuvent sortir ni hommes ni femmes, les hommes ont peur que les femmes les dévorent, les mutilent, les mettent à mort. Ils ont peur de la jouissance de la femme qu'ils considèrent comme mortellement insatiable dès lors qu'elle n'est plus captive, mais libre ou libérée. Pour juguler la Grande Peur, toutes les sociétés ont mis au point des mécanismes qui divisent l'être des femmes en deux, répartissent le danger et permettent de le contrôler : d'un côté les mères et leurs assimilées, de l'autre côté les putains et leurs assimilées ; d'un côté la reproduction, de l'autre la jouissance. Ce mécanisme de coupure se reporte sur les enfants, la reproduction légale servant à trier les héritiers — ceux que l'on nomme légitimes — et ceux qui n'héritent pas — ceux que l'on nomme illégitimes. On peut alors comprendre le scandale des mères célibataires. Selon les époques, la division des femmes en deux est plus ou moins marquée : moins elle l'est, plus les femmes sont libres et plus les maternités hors mariage sont considérées comme normales et moins il y a de différence entre les héritiers et les bâtards. Il y a donc là un critère décisif d'évaluation des sociétés, qui explique sans doute que les mythes et la littérature ne cessent de porter une constante rumeur, celle d'une force fondatrice propre aux enfants illégitimes, la force de bâtardise.
