L’espropriazione per pubblica utilità, per la sua immanenza al diritto di proprietà e alla sua stessa concezione, costituisce da sempre uno specchio dell’evoluzione, non solo giuridica, ma anche economica, sociale, politica dell’ordinamento. È istituto nel quale confluiscono le esigenze mutevoli, i valori diversi di ogni momento storico; in esso si esprime la sintesi tra le varie tensioni, riconducibili, in definitiva, con qualche approssimazione, ad una sola: quella della perenne ricerca di un equilibrio tra l’interesse del-la collettività e quello del privato proprietario. Concetto enunciato a chiare lettere in Costituzione: della proprietà la legge “determina i modi di acquisto, di godimento e i limiti allo scopo di assicurarne la funzione sociale”, ammettendone l’espropriazione “per motivi di interesse generale”. Non diversamente, lo Statuto albertino prevedeva che la proprietà dovesse essere ceduta quando “l’interesse pubblico legalmente accertato”, lo esigesse. L’interesse per l’espropriazione è perciò sempre attuale e, si potrebbe dire, “trascendente”, andando oltre quello per l’istituto in sé, involvendo quello per l’ordinamento giuridico e per la realtà sociale nel quale si collo-ca.
