Sous la direction du professeur Rafael Casado Raigon, le présent volume contient les résultats du Colloque de l'Association internationale du Droit de la mer (AssIDMer) qui, sur le thème l'Europe et la mer, s'est tenu à la Faculté de Droit de Cordoue (Espagne) les 16, 17 et 18 octobre 2003 et auquel a participé une centaine de juristes et maritimistes prestigieux venus des quatre continents (Europe, Asie, Afrique et Amérique) et d'une vingtaine de pays. Les travaux développés lors dudit colloque ont été répartis en trois sessions, la première consacrée à la pêche maritime, la seconde à la navigation maritime et la troisième à l'environnement marin. Chacune des trois sessions était composée d'un rapport général et de divers rapports spécifiques. Le Colloque prit fin avec les conclusions générales, élaborées par le président de l'AssIDMer, le professeur Daniel Vignes. Après les conclusions générales, paraissent également diverses communications (rapports complémentaires) qui furent envoyées ou déposées avant ou au cours du colloque.

It explores the diverse phenomena which are challenging the international law of the sea today, using the unique perspective of a simultaneous analysis of the national, individual and common interests at stake. This perspective, which all the contributors bear in mind when treating their own topic, also constitutes a useful element in the effort to bring today’s legal complexity and fragmentation to a homogenous vision of the sustainable use of the marine environment and of its resources, and also of the international and national response to maritime crimes.The volume analyzes the relevant legal frameworks and recent developments, focusing on the competing interests which have influenced State jurisdiction and other regulatory processes. The Red Sea has, from time immemorial, been one of the worldÕs most navigated spaces, in the pursuit of trade, pilgrimage and conquest. Yet this multidimensional history remains largely unrevealed by its successive protagonists. Intrigued by the absence of a holistic portrayal of this body of water and inspired by Fernand BraudelÕs famous work on the Mediterranean, this book brings alive a dynamic Red Sea world across time, revealing the particular features of a unique historical actor. In capturing this heretofore lost space, it also presents a critical, conceptual history of the sea, leading the reader into the heart of Eurocentrism. The Sea, it is shown, is a vital element of the modern philosophy of history. Alexis Wick is not satisfied with this inclusion of the Red Sea into history and attendant critique of Eurocentrism. Contrapuntally, he explores how the world and the sea were imagined differently before imperial European hegemony. Searching for the lost space of Ottoman visions of the sea, The Red Sea makes a deeper argument about the discipline of history and the historianÕs craft.

The geography and the history of Mediterranean Europe are very different from those of the other European regions, but their role in the relationships with the other shores of the Mediterranean can be of great assistance to Europe as a whole. All the countries bordering the sea that witnessed the birth of some of the major civilisations of the world share a long tradition of economic and cultural relations. In the past numerous diasporas knit the harbour cities together, transmitting the ideas of the Enlightenment; today an uninterrupted flow of raw materials traverses the Mediterranean, together with people, ideas and technology. The European Union is called upon to develop a major Mediterranean policy, both through the accession of new countries, and by means of a policy of neighbourhood or of privileged associations. The principal tool should be a cultural policy that serves as a bridge between east and west, north and south. A common policy to spread the values contained in the project of the European constitution. In its motto «United in diversity», the Union recognises diversity as its most valuable asset. The countries of Mediterranean Europe, with their experience and their knowledge, can make a precious contribution to this policy. This book, the fruit of international co-operation among 20 researchers, offers a contribution to the study of Mediterranean Europe not only in the historic, economic, demographic and politological ambit, but also in the sphere of international relations and cultural policy.

Under Article 38 of its Statute, the International Court of Justice can apply judicial decisions only as a “subsidiary means for the determination of rules of law”. However, there are many reasons to believe that international courts and tribunals do play quite an important role in the progressive development of international law.
