Le Code civil français a exercé une influence considérable en Afrique. En République démocratique du Congo, les Belges l'ont introduit dès 1888 lors de la colonisation. En matière de droit des personnes et de la famille, le système juridique congolais, alors basé sur le droit coutumier non écrit, s'est doté d'un droit rationalisé calqué sur le modèle français. Après l'indépendance, les pouvoirs publics congolais ont voulu remplacer ce "Code colonial", lacunaire et inadapté. Les travaux engagés sur la partie relative aux droits des personnes et de la famille ont abouti à la promulgation en 1987 du Code de la famille. Mais ce nouveau code congolais a aujourd'hui vieilli : la présente étude propose plusieurs pistes de rénovation.

This groundbreaking collection of essays shows that, from the moment European expansion commenced through to the twentieth century, indigenous peoples from America, Africa, Australia and New Zealand drafted legal strategies to contest dispossession. The story of indigenous resistance to European colonization is well known. But legal resistance has been wrongly understood to be a relatively recent phenomenon. These essays demonstrate how indigenous peoples throughout the world opposed colonization not only with force, but also with ideas. They made claims to territory using legal arguments drawn from their own understanding of a law that applies between peoples - a kind of law of nations, comparable to that being developed by Europeans.
