La conoscenza dei principi del Diritto Europeo di Polizia è essenziale per una efficace cooperazione tra le forze di Polizia dei paesi membri dell'Unione Europea. La criminalità organizzata, il terrorismo, la tratta di esseri umani, i crimini contro i minori, il traffico di droga di armi, la corruzione e la frode, costituiscono una minaccia per i cittadini di tutta l'unione europea. Le istituzioni dell'unione e degli stati membri devono prevenire e combattere questo fenomeno unendo i loro sforzi tenendo conto sia del carattere spesso transfrontaliero della criminalità sia delle nuove forme di minaccia connesse con i mutamenti economici, sociali e politici. L'articolo 29 del trattato sull'UE l'assegna all'Unione il compito di assicurare ai cittadini un livello elevato di protezione in uno spazio di libertà, di sicurezze e di giustizia, elaborando un’ azione comune degli stati membri in materia di cooperazione di polizia e giudiziaria in materia penale Davanti al numero crescente di organizzazioni criminali che agiscono simultaneamente in numerosi stati, la cooperazione e lo scambio di informazioni tra i servizi repressivi dei paesi e interessati sono il primo strumento della lotta contro la criminalità organizzata. Dopo l'entrata in vigore della convenzione di Schengen, tutti gli sforzi per stabilire una cooperazione in materia repressiva si sono concentrati sul miglioramento della condivisione delle informazioni tra servizi di polizia. Benché lo scambio di informazioni costituisca il cuore della cooperazione di polizia esso resta inferiore a quello necessario per assicurare una cooperazione adeguata tra i servizi repressivi. Che fare? La risposta può essere rinvenuta solo nell’ambito dell’ordinamento giuridico europeo, che imponga agli Stati membri quelle misure organizzative che, da soli, non sarebbero in grado di adottare. In quest'ottica, infatti, il diritto adottato dalle istituzioni dell'Unione nell'esercizio delle competenze a questa attribuite, prevalgono sul diritto degli Stati membri. Questo principio trae origine dalla giurisprudenza della Corte di Giustizia che in numerose sentenze, nel contrasto tra le normative nazionali e le direttive comunitarie, ha affermato la supremazia di queste ultime Già la sentenza Costa/Enel del 15 luglio 1964 aveva precisato che "il diritto nato dal trattato non potrebbe...... trovare un limite in qualsiasi provvedimento interno senza perdere il proprio carattere comunitario e senza che ne risultasse scosso il fondamento giuridico della stessa Comunità". La sentenza Handelsgesellschaft del 17 dicembre 1970 aveva affermato che la validità di un atto cumunitario non è sminuita neppure dal richiamo "ai diritti fondamentali, per come formulati nella costituzione di uno stato membro, oppure ai principi costituzionali nazionali”. La sentenza Tanja Kreil del 11 gennaio 2000, infine, ha stabilito che, perfino nel contrasto con una norma costituzionale, la direttiva 76/207/CEE, relativa all'attuazione del principio della parità di trattamento e fra gli uomini e le donne per quanto riguarda l'accesso al lavoro, è ostativa alle eventuali disposizioni nazionali (come ad esempio l’art. 12 della legge fondamentale tedesca) che escludono le donne dagli impieghi militari o ne limitano l’utilizzo.

This book centres on the ways in which the concept of imperativeness has found expression in private international law (PIL) and discusses “imperative norms”, and “imperativeness” as their intrinsic quality, examining the rules or principles that protect fundamental interests and/or the values of a state so as to require their application at any cost and without exceptions. Discussing imperative norms in PIL means referring to international public policy and overriding mandatory rules: in this book the origins, content, scope and effects of both these forms of imperativeness are analyzed in depth. This is a subject deserving further study, considering that very divergent opinions are still emerging within academia and case law regarding the differences between international public policy and overriding mandatory rules as well as with regard to their way of functioning. By using an approach mainly based on an analysis of the case law of the CJEU and of the courts of the various European countries, the book delves into the origin of imperativeness since Roman law, explains how imperative norms have evolved in the different conceptions of private international law, and clarifies the foundation of the differences between international public policy and overriding mandatory rules and how these concepts are used in EU Regulations on PIL (and in the practice related to these sources of law). Finally, the work discusses the influence of EU and public international law sources on the concept of imperativeness within the legal systems of European countries and whether a minimum content of imperativeness – mainly aimed at ensuring the protection of fundamental human rights in transnational relationships – between these countries has emerged. The book will prove an essential tool for academics with an interest in the analysis of these general concepts and practitioners having to deal with the functioning of imperative norms in litigation cases and in the drafting of international contracts.
