La présente thèse a pour thème, « l'État et les coutumes au Cameroun des origines à la Constitution révisée de 1996 : contribution à une théorie pluraliste du droit en Afrique noire postcoloniale ». Elle se propose de participer à la résolution de la crise entre le droit produit par l'État et les pratiques sociales au Cameroun et en Afrique noire. Ainsi, après avoir démontré l'incompatibilité des politiques législatives de l'État vis-à-vis des coutumes, cette thèse questionne les dynamiques propres aux sociétés coutumières. De sorte qu'il en ressort des principes directeurs de la coutume, par le recours à la philologie historique, pour saisir son sens premier à partir des antiquités africaines. Ce faisant, sont ruinées la théorie unitaire de l'État en Afrique noire, son épistémologie fondatrice et sa prétention à incarner d'autorité, l'ordre et le droit. La présente thèse implique ainsi de redéfinir la coutume et introduit de plein droit une nouvelle période de recherche fondamentale, à travers cette conception nécessaire dans la perception même du paradigme local et son appropriation. Tout comme elle induit des mutations profondes et des ruptures qui permettent de réarticuler la connaissance directe des deux registres normatifs en concours, et d'orthographier autrement le vivre ensemble. Dans la quête des institutions adaptées aux sociétés plurielles, l'apport de cette thèse aura résidé dans la prise en compte du point de vue des acteurs du paradigme coutumier de régulation, souvent occulté par des idéologies autoritaires, des simplifications abusives et l'emploi des arguments controuvés, au service d'une stratégie : la domination et la minoration du local.
