Nel presente lavoro si sono analizzati il dibattito dottrinale e gli scontri giurisprudenziali scaturiti dalla legge n. 164 del 1982 sulla rettificazione del sesso. Operata un’introduzione storico-concettuale sull’identità di genere, nel primo capitolo si è esaminata la condizione delle persone transgender nei limiti morali e normativi imposti dall’Italia degli anni Settanta, quando la rettificazione del sesso non era ancora regolamentata. Nel secondo capitolo, si è descritta la legge nelle sue singole disposizioni tentando di tratteggiarne il contesto generale dell’epoca, per poi esporre le difficoltà interpretative emerse negli anni successivi, con riguardo in particolare al procedimento e alla precondizione dell’incapacità generativa. Nel terzo capitolo, l’attenzione è stata posta sugli effetti della rettificazione nella famiglia, con un particolare focus sul c.d. divorzio imposto ex lege nel caso di persona transessuale coniugata. Infine, nel quarto capitolo, si è dato spazio al diritto antidiscriminatorio interno in una dimensione regione e ad alcune significative buone prassi che hanno interessato anche l’amministrazione penitenziaria.
