Desde el Departamento de Historia Contemporánea de la UNED se organizó a finales de noviembre de 2016 el «Congreso internacional nación y nacionalismo en la España de las autonomías». Contando con la presencia de especialistas de ámbitos histórico, jurídico, sociológico y politológico, se realizó entonces un análisis del proceso de transformación de la España del último medio siglo y de la trascendencia del modelo de organización territorial que supuso el desarrollo del Estado de las autonomías. Esta obra es la plasmación de las ponencias presentadas a dicho congreso, revisadas y organizadas en doce capítulos, bajo la coordinación de Isidro Sepúlveda Muñoz, profesor titular de Historia Contemporánea de la UNED. De la visión de España en el exilio republicano a la construcción de una nueva idea de España a la luz de la Constitución de 1978, pasando por la particular idea de España del franquismo, la obra analiza también la incidencia de lo que pudiéramos llamar el conglomerado nacionalista periférico (sus familias, organizaciones, partidos y carga ideológica): inicio y explosión final en octubre de 2017 del sentimiento independentista en Cataluña, nacimiento y penetración del terrorismo etarra en la sociedad vasca, actitud y estrategias de los principales partidos políticos españoles y valoración de la posibilidad de construir un concepto integrador de nación española, y de las amenazas a que dicho proyecto está expuesto en estos momentos.

This book analyses the rise and decline of the Basque terrorist group Euskadi Ta Askatasuna (ETA, Basque Homeland and Freedom). ETA declared a unilateral ceasefire in November 2011, bringing to a close a campaign of political violence that started in the late 1960s. By the beginning of the twenty-first century, the overwhelming majority of secession supporters agreed that an independent Basque homeland would be realised through ‘ballots’ and not ‘bullets’. Providing an inter-disciplinary overview of radical Basque nationalism that pays special attention to the drivers for ETA’s decline, defeat and disbandment, this book includes chapters by historians, political scientists and sociologists who offer three important theoretical and empirical contributions to the literature on nationhood and security studies. Firstly the book re-assesses the military conflict that opposed ETA and the Spanish state, by paying special attention to tactical and strategic considerations as well as the counter-terrorist policy itself. Secondly it provides an original interpretation of the politics of fear which surrounded the process of victimization, as well as assessing the extent to which the issue of violence led to the polarisation of citizens. Thirdly the authors examine the historical narratives and rituals that contributed to the production and reproduction of identity binaries and memories of war. Arguing that the defeat of ETA must be contextualised within the strategic evolution of Basque nationalism, the declining resonance of the radical message and the effectiveness of the Spanish counter-terrorist effort, this book is essential reading for students and scholars working in the areas of European politics, nationalism and terrorism studies.

Mediterranean states are often thought to have 'democratised' only in the post-war era, as authoritarian regimes were successively overthrown. On its eastern and southern shores, the process is still contested. Re-imagining Democracy looks back to an earlier era, the late eighteenth and early nineteenth centuries, and argues it was this era when some modern version of 'democracy' in the region first began. By the 1860s, representative regimes had been established throughout southern Europe, and representation was also the subject of experiment and debate in Ottoman territories. Talk of democracy, its merits and limitations, accompanied much of this experimentation - though there was no agreement as to whether or how it could be given stable political form. Re-imagining Democracy assembles experts in the history of the Mediterranean, who have been exploring these themes collaboratively, to compare and contrast experiences in this region, so that they can be set alongside better-known debates and experiments in North Atlantic states. States in the region all experienced some form of subordination to northern 'great powers'. In this context, their inhabitants had to grapple with broader changes in ideas about state and society while struggling to achieve and maintain meaningful self-rule at the level of the polity, and self-respect at the level of culture. Innes and Philip highlight new research and ideas about a region whose experiences during the 'age of revolutions' are at best patchily known and understood, as well as to expand understanding of the complex and variegated history of democracy as an idea and set of practices.

One of great figures in the field, the Argentinian legal historian Víctor Tau Anzoátegui, published in 1997 his Nuevos horizontes en el estudio histórico del derecho indiano. The book, in which Tau addressed seminal methodological questions setting tone for the discipline’s future orientation, proved to be the starting point for an important renewal of the discipline. Tau drew on the writings of legal historians, such as Paolo Grossi, Antonio Manuel Hespanha, and Bartolomé Clavero. Tau emphasized the development of legal history in connection to what he called “the posture superseding rational and statutory state law.” The following features of normativity were now in need of increasing scholarly attention: the autonomy of different levels of social organization, the different modes of normative creativity, the many different notions of law and justice, the position of the jurist as an artifact of law, and the casuistic character of the legal decisions. Moreover, Tau highlighted certain areas of Spanish colonial law that he thought deserved more attention than they had hitherto received. One of these was the history of the learned jurist: the letrado was to be seen in his social, political, economic, and bureaucratic context. The Argentinian legal historian called for more scholarly works on book history, and he thought that provincial and local histories of Spanish colonial law had been studied too little. Within the field of historical science as a whole, these ideas may not have been revolutionary, but they contributed in an important way to bringing the study of Spanish colonial law up-to-date. It is beyond doubt that Tau’s programmatic visions have been largely fulfilled in the past two decades. Equally manifest is, however, that new challenges to legal history and Spanish colonial law have emerged. The challenges of globalization are felt both in the historical and legal sciences, and not the least in the field of legal history. They have also brought major topics (back) on to the scene, such as the importance of religious normativity within the normative setting of societies. These challenges have made scholars aware of the necessity to reconstruct the circulation of ideas, juridical practices, and researchers are becoming more attentive to the intense cultural translation involved in the movement of legal ideas and institutions from one context to another. Not least, the growing consciousness and strong claims to reconsider colonial history from the premises of postcolonial scholarship expose the discipline to an unseen necessity of reconsidering its very foundational concepts. What concept of law do we need for our historical studies when considering multi-normative settings? How do we define the spatial dimension of our work? How do we analyze the entanglements in legal history? Until recently, Spanish colonial law attracted little interest from non-Hispanic scholars, and its results were not seen within a larger global context. In this respect, Spanish colonial law was hardly different from research done on legal history of the European continent or common law. Spanish colonial law has, however, recently become a topic of interest beyond the Hispanic world. The field is now increasingly seen in the context of “global legal history,” while the old and the new research results are often put into a comparative context of both European law of the early Modern Period and other colonial legal orders. In this volume, scholars from different parts of the Western world approach Spanish colonial law from the new perspectives of contemporary legal historical research."
