Podemos decir que aparece en la vida de la más antigua filosofía: desde Arístóteles llega hasta Hobbes y Romagnosi. El positivismo lo ha tomado para sí, con posterioridad. Aunque en una postura ecléctica, Adolphe Prins (La defensa social y las transformaciones del Derecho penal, Bruselas, 1910) sostuvo como fundamento del Derecho penal el concepto de defensa social, Liszt, en nombre de los principios de la defensa social, aún sin citar de modo suficiente las fuentes, tal y como dice Ferri, solicita en la Unión Internacional de Derecho penal la evolución del Derecho penal".
