Moving from a historical and cultural perspective, this book examines the geo-political and socio-economic changes involving the enlarged Mediterranean. Organised into two main sections, the first section (The new centrality of the Mediterranean Basin: Trends and Dynamics) is devoted to the analysis of the most relevant drivers and interdisciplinary broader issues, and the second section (Hotspots of Crisis and Regional Interferences in the Mediterranean) assesses the situation in some areas interested by the waves of uprisings since 2011-12. The book aims to uncover this new, critical centrality of the Mediterranean in the global scenario through the analysis of the interactions and intertwining of those trends and dynamics offering a historical holistic broad view. Intimate image abuse is a recent, endemic phenomenon which raises multiple legal issues and presents a significant challenge for the traditional institutions of law and criminal justice. The nature of this phenomenon requires considering the traditional complexities of regulating privacy, sexual offences, and cybercrimes, alongside the social and cultural issue of what may be considered 'intimate', 'private', or indeed 'sexual'. Since the harm experienced by victims of intimate image abuse is particularly serious and involves disparate legal interests, criminal law has been invoked as one of the solutions, but it is unclear what its role and limits should be. The law's approach should avoid any moralistic attitude, trying to achieve a balance between sexual autonomy and the protection of sexual privacy. At the same time, the needs of criminalization must be balanced with the traditional principles of criminal law. Criminalizing Intimate Image Abuse strives primarily to generate new conceptual and theoretical frameworks to address the legal responses to this phenomenon, by bringing together a number of scholars involved in the study of intimate image abuse over recent years. This volume compares the solutions developed in different legal systems. The perspective is mainly focused on the comparison between the Anglo-American criminalization model and that of continental Europe, but there are also overviews of the criminalization trends in Asian and Latin American countries. Once the criminalization of intimate image abuse, as well as its theoretical and practical limits, have been established, the analysis focuses on possible new legal strategies, complementary or alternative to traditional criminal justice, such as restorative justice. Finally, in order to achieve an effective safeguard for victim-survivors, the book deals with the role of Internet Service Providers and bystanders in preventing intimate image abuse.

Siamo stati affascinati per anni dai visionari del web, ma il nostro futuro è fatto di dati, di sorveglianza, di guerre tra gli Stati e le potenze economiche della tecnologia digitale. Quale deve essere la risposta dei governi? E le democrazie sono abbastanza forti da resistere a questa tempesta? Fino ad oggi l’Italia, insieme a molti altri paesi, si è fatta trascinare dai produttori di tecnologia. All’inizio dell’epoca della rete siamo stati sedotti da servizi attraenti e apparentemente gratuiti. Poi è nato un mondo nuovo, tutto di proprietà delle Big tech, pieno di opportunità ma anche carico di distorsioni potenzialmente fatali per la democrazia. Controllo dell’informazione e controllo dei dati degli utenti: a stravolgere i pesi e i contrappesi su cui si basano i sistemi democratici non sono la tecnologia né il web, ma è il modo in cui questi strumenti vengono manipolati da enormi concentrazioni di potere economico. La battaglia non è finita. Anzi, è appena cominciata. Abbiamo tre montagne da scalare: definire i rischi di uno sviluppo senza controlli della tecnologia, concordare i sistemi di regole che si applicano agli operatori, introdurre un freno efficace allo strapotere dei monopoli. L’Europa ha la volontà politica di andare avanti ma non ha la forza sufficiente. Gli Stati Uniti hanno la forza ma non riescono a esprimere la volontà politica. La Cina interviene mettendo la museruola ai grandi capitalisti dell’economia digitale ma il suo obiettivo non è quello di rendere il sistema aperto, bensì di rafforzare il suo potere autoritario. Se il mantenimento dell’ordine e la sorveglianza sociale verranno affidati alle macchine senza controlli, se l’intelligenza artificiale generativa sarà in grado di sostituire l’uomo anche nella creatività, si farà sempre più fatica a difendere gli spazi di libertà dal grande Leviatano tecnologico. Non possiamo permetterci di cedere alla logica che vede nella presunta saggezza dell’algoritmo il fattore che rende obsoleto il dibattito democratico. È questa la sfida che abbiamo davanti, la deriva che dobbiamo arrestare. Non respingendo la tecnologia ma governandola.

E dobbiamo anche dire Tempo imperfetto per cogliere la natura del compito o il profilo del progetto educativo. La grandezza dell’uomo è nell’accettazione di sé. Al di là della siepe c’è l’infinito, e quindi anche il sogno, il desiderio, l’immaginazione e lo slancio vitale: il punto di congiunzione che lega lo spazio e il tempo, il presente e il futuro, la regola e la possibilità di trasgressione, l’esperienza e la padronanza di sé, la competenza e la capacitazione, nell’esercizio attivo ed efficace di una cittadinanza dignitosa, leale, accogliente, partecipe ed attenta alle generazioni che verranno.
