Il testo descrive le “rappresentazioni sociali normative” (da intendersi come le mappe mentali comuni che condizionano l’interiorizzazione delle norme) di un campione di genitori marocchini e di un campione di giudici minorili italiani in relazione a quella clausola generale che i giuristi chiamano “best interest of the child”. L’ipotesi di ricerca che viene qui avanzata è che il modo di concepire e di utilizzare cognitivamente tale clausola da parte dei due gruppi di attori oggetto della ricerca condizionino il modo in cui le norme italiane in materia di esercizio, di limitazione e di decadenza della potestà genitoriale sono applicate. Ciò consentirà di evidenziare se le rappresentazioni che le persone impiegano a livello implicito possano rischiare di comportare l’inefficacia di alcuni provvedimenti emessi dall’autorità giudiziaria.

Da tempo il diritto ci appare come un fenomeno sconfinato, sul quale siamo naturalmente portati a riflettere a partire da un raffronto tra esperienze giuridiche. Il diritto comparato si è da sempre interessato a questo fenomeno, tradizionalmente per sostenere le ragioni della convergenza, e per farlo con un piglio evoluzionista. Nel tempo le cose sono cambiate. Per un verso ha preso corpo la volontà di preservare le identità delle esperienze giuridiche, per un altro si è avvertita la necessità di superare l’approccio evoluzionista e di adottarne in sua vece uno diffusionista. Il risultato è un rimescolamento delle sensibilità con cui ci si accosta al raffronto tra esperienze giuridiche, del resto in linea con una fase storica per molti aspetti caratterizzata da giudizi critici sulla globalizzazione. Gli autori di questo volume si sono confrontati su questi aspetti in chiave critica e mettendo in luce differenti sensibilità nei diversi campi del sapere giuridico: dal diritto privato al diritto al diritto pubblico, passando per il diritto del lavoro.
