Il lavoro che qui si ripubblica consolida una più generale visione di Franco Bricola sul diritto penale nel suo momento più cruciale, quello della applicazione da parte del giudice e degli spazi di discrezionalità che la norma ed il sistema attribuiscono all’interprete. A ben vedere si tratta di un’opera sul potere giudiziario penale le cui intuizioni si proiettano anche a 60 anni di distanza. Il primo ed il terzo capitolo, incentrati sulla discrezionalità nella commisurazione delle pene, interrogano la società sulla Giustizia e – in tempi in cui si prospettano meccanismi di “intelligenza artificiale” per la loro determinazione – sulla costante tensione fra libertà e sanzione, fra prevenzione e punizione. Il secondo capitolo rilegge il sistema alla luce delle norme costituzionali ed in particolare della nozione di tassatività della norma penale – scripta, stricta, certa et praevia – ponendo i limiti ad una interpretazione espansiva nella quale la discrezionalità trascolora in arbitrio. Se molto ricca è l’esperienza pastorale della Chiesa nel campo della comunicazione, appare tanto più necessario studiare i complessi profili canonistici del rapporto che intercorre tra i munera propri della Chiesa e gli strumenti di comunicazione sociale, in relazione alle problematiche nuove e alle emergenze future che presentano le questioni legate ai mass media e alle prospettive sia pastorali sia de iure condendo ad esse legate. Il Magistero contemporaneo ha dimostrato di non temere le profonde trasformazioni intervenute in questo campo; ora si tratta, però, di individuare i percorsi che, anche sul piano della riflessione scientifica, consentano di mantenere integri i capisaldi dottrinali della Chiesa, tutelandoli dal relativismo e dalla mercificazione, che sono le note dominanti dell’odierna modalità di fare comunicazione. Lo strumento mediatico, infatti, se può favorire il compito missionario della Chiesa, nello stesso tempo nasconde per essa gravi minacce, che riguardano non solo la difesa dei fedeli sul piano propriamente etico, ma la stessa solidità nella diffusione della dottrina.
