Este libro aborda las alternativas de vigencia temporal del derecho a la impugnación de la primera sentencia condenatoria en el régimen de procedimiento penal colombiano. A tales efectos, en primer término valora los desarrollos del corpus iuris internacional de los derechos humanos en materia del derecho a la impugnación de la sentencia de condena. En segundo lugar, analiza la recepción de dichos instrumentos en los regímenes de procedimiento penal del derecho interno de Colombia, y enfatiza en los desarrollos jurisprudenciales de la doble conformidad. Con ese fundamento, el texto subraya la insuficiencia del statu quo de aplicación retroactiva del derecho a la impugnación. Por último, somete a examen diversas posibilidades de aplicación temporal, y concluye que el derecho a impugnar la primera sentencia condenatoria debe reconocerse en el ordenamiento jurídico colombiano desde la fecha de promulgación de la Constitución Política de 1991.

"Este trabajo de investigación aborda aspectos del derecho sancionador administrativo en materia tributaria, con especial referencia al ámbito local y desde una óptica de comparación paralela de las legislaciones española y venezolana. Dentro del área de derecho tributario se desarrollan aspectos vinculados con el ámbito constitucional relativos al tema, por considerar pertinente una referencia de tal naturaleza en la primera fase de cualquier estudio que se oriente, como en este caso, al control de la actividad administrativa; habida cuenta de ser el Texto Fundamental el parámetro principal de creación, validez e interpretación del resto de normas, lo que se refuerza al considerar que se trata de una rama del Derecho que disciplina la actuación de la administración pública. Una vez definidos los límites que observa esta potestad, se consideran las sanciones referidas a la materia que tratamos, las cuales representan los instrumentos a los que la administración tributara recurre cuando intenta proteger el cumplimiento de la normativa que la ampara en un Estado de Derecho. El propósito de esta investigación es plantear la consecución de mecanismos que permitan validar de modo eficaz las exacciones tributarias y la mejor manera de poner en práctica el sistema sancionar en dicha materia, dentro de un marco de respaldo a los derechos de los contribuyentes, para lo que se ha creído imprescindible un inequívoco deslinde competencial entre las áreas del poder público y entre los niveles de gobiernos que integran el Estado". This publication is an initiative of the European Forum for Victim-Offender Mediation and Restorative Justice, and results from its first conference which was held in Leuven, Belgium, from 27-29 October 1999. The first six chapters consider victim-offender mediation and restorative justice from a more theoretical point of view. These analyses of theoretical, legal, policy, ethical and societal aspects of mediation and restorative justice have been written by well-known scholars in this field. The second part of the book consists of overviews of the situation with regard to victim-offender mediation in the eight European countries in which it is currently the most developed (Austria, Belgium, Finland, France, Germany, Norway, Poland and the United Kingdom). For these last chapters, a multitude of information was collected in each of these countries, and this is presented and analysed comparatively. The following topics are discussed for each of the countries: the history of victim-offender mediation in that particular country, the legal context, policy and implementation, the number of programmes and the way they function, the practice of mediation, the number and characteristics of cases, evaluation and research, and finally challenges, obstacles and expectations for the future. This is probably the first time that such extensive reports on the practice of victim-offender mediation in Europe have been brought together in this way. In publishing this book the European Forum is seeking to contribute to the realisation of one of its objectives, namely providing people all over Europe - and beyond - with information on victim-offender mediation and restorative justice in other countries. Restorative justice is a relatively new field and is still very much evolving. A full exchange of information and ideas will contribute to this process.
